中共中央、國務院:行業協會商會擬后年與行政機關脫鉤

  新華社北京(jing)7月(yue)8日電 中共中央(yang)辦公廳(ting)、國務院辦公廳(ting)近日印發了(le)《行(xing)業協會商會與行(xing)政機關(guan)脫(tuo)鉤總體方(fang)案》,并發出(chu)通(tong)知,要求各地(di)區各部門結合實際認真貫(guan)徹執(zhi)行(xing)。

  行(xing)業(ye)協(xie)會(hui)(hui)商(shang)(shang)會(hui)(hui)是我國經濟建設和(he)社(she)(she)會(hui)(hui)發(fa)(fa)展(zhan)(zhan)的重要力量。改(gai)革開放以來,隨(sui)著社(she)(she)會(hui)(hui)主義市場經濟體制的建立和(he)完善(shan),行(xing)業(ye)協(xie)會(hui)(hui)商(shang)(shang)會(hui)(hui)發(fa)(fa)展(zhan)(zhan)迅速,在為政(zheng)府(fu)提供咨詢(xun)、服務(wu)企業(ye)發(fa)(fa)展(zhan)(zhan)、優化資源配置、加(jia)強(qiang)行(xing)業(ye)自(zi)律、創(chuang)新社(she)(she)會(hui)(hui)治(zhi)理(li)(li)、履行(xing)社(she)(she)會(hui)(hui)責任等方(fang)面發(fa)(fa)揮(hui)了積(ji)極作用。目前,一些行(xing)業(ye)協(xie)會(hui)(hui)商(shang)(shang)會(hui)(hui)還存在政(zheng)會(hui)(hui)不(bu)分、管辦一體、治(zhi)理(li)(li)結構(gou)不(bu)健全、監督管理(li)(li)不(bu)到(dao)位、創(chuang)新發(fa)(fa)展(zhan)(zhan)不(bu)足、作用發(fa)(fa)揮(hui)不(bu)夠等問題。按照(zhao)《中(zhong)共中(zhong)央(yang)關于全面深化改(gai)革若干(gan)重大(da)問題的決(jue)定(ding)》、《國務(wu)院機構(gou)改(gai)革和(he)職能轉變方(fang)案》有關精神和(he)工作部署,為加(jia)快(kuai)轉變政(zheng)府(fu)職能,實現行(xing)業(ye)協(xie)會(hui)(hui)商(shang)(shang)會(hui)(hui)與行(xing)政(zheng)機關脫鉤,促進(jin)行(xing)業(ye)協(xie)會(hui)(hui)商(shang)(shang)會(hui)(hui)規(gui)范發(fa)(fa)展(zhan)(zhan),制定(ding)本(ben)方(fang)案。

  一、總體(ti)要求(qiu)和基(ji)本原則

  (一)總體(ti)要求

  貫徹落實黨(dang)的(de)(de)十八大和(he)(he)(he)十八屆二中(zhong)、三中(zhong)、四中(zhong)全會(hui)(hui)(hui)精神,加快形成政社分開(kai)、權責明確、依(yi)法自(zi)治的(de)(de)現代社會(hui)(hui)(hui)組織(zhi)體(ti)制,理(li)(li)清政府、市場、社會(hui)(hui)(hui)關系,積極(ji)穩(wen)妥推進(jin)行(xing)(xing)(xing)業協會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)與行(xing)(xing)(xing)政機(ji)關脫鉤(gou),厘清行(xing)(xing)(xing)政機(ji)關與行(xing)(xing)(xing)業協會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)的(de)(de)職(zhi)能邊(bian)界,加強綜合監(jian)管(guan)和(he)(he)(he)黨(dang)建工作,促進(jin)行(xing)(xing)(xing)業協會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)成為依(yi)法設(she)立(li)、自(zi)主辦會(hui)(hui)(hui)、服務為本、治理(li)(li)規范(fan)、行(xing)(xing)(xing)為自(zi)律(lv)的(de)(de)社會(hui)(hui)(hui)組織(zhi)。創新(xin)行(xing)(xing)(xing)業協會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)管(guan)理(li)(li)體(ti)制和(he)(he)(he)運行(xing)(xing)(xing)機(ji)制,激發內在活力(li)和(he)(he)(he)發展(zhan)動力(li),提升行(xing)(xing)(xing)業服務功能,充分發揮行(xing)(xing)(xing)業協會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)在經濟發展(zhan)新(xin)常態中(zhong)的(de)(de)獨特優勢和(he)(he)(he)應有(you)作用。

  (二)基(ji)本原則

  堅持社會(hui)(hui)化(hua)、市(shi)場化(hua)改革(ge)(ge)方向。圍繞使市(shi)場在資源配置中(zhong)起決定性作(zuo)用(yong)和(he)更好發(fa)揮政(zheng)府作(zuo)用(yong),改革(ge)(ge)傳(chuan)統(tong)的行(xing)(xing)(xing)政(zheng)化(hua)管(guan)(guan)理方式,按照(zhao)去(qu)行(xing)(xing)(xing)政(zheng)化(hua)的要求,切斷(duan)行(xing)(xing)(xing)政(zheng)機關和(he)行(xing)(xing)(xing)業(ye)協會(hui)(hui)商會(hui)(hui)之間的利(li)益鏈條,建立新型管(guan)(guan)理體制和(he)運行(xing)(xing)(xing)機制,促(cu)進和(he)引(yin)導行(xing)(xing)(xing)業(ye)協會(hui)(hui)商會(hui)(hui)自主運行(xing)(xing)(xing)、有序競爭、優化(hua)發(fa)展。

  堅持法制化、非(fei)營利原(yuan)則。加快行(xing)(xing)業(ye)協會(hui)商(shang)會(hui)法律(lv)制度(du)建(jian)設,明確脫鉤后(hou)的(de)法律(lv)地(di)位,實現依法規(gui)范運行(xing)(xing)。建(jian)立準入和退(tui)出機制,健全綜合監管(guan)體系。各級政(zheng)府要(yao)明確權(quan)(quan)力邊(bian)界,實現權(quan)(quan)力責任統一、服務監管(guan)并重。按照非(fei)營利原(yuan)則要(yao)求,規(gui)范行(xing)(xing)業(ye)協會(hui)商(shang)會(hui)服務行(xing)(xing)為,發揮對會(hui)員的(de)行(xing)(xing)為引導、規(gui)則約(yue)束和權(quan)(quan)益維護作用(yong)。

  堅持服務發展(zhan)、釋放市(shi)場(chang)活力(li)。提(ti)升(sheng)行(xing)業(ye)(ye)協會(hui)商會(hui)專業(ye)(ye)化(hua)水平和能(neng)力(li),推動服務重心從政府(fu)轉(zhuan)向企業(ye)(ye)、行(xing)業(ye)(ye)、市(shi)場(chang)。通過提(ti)供(gong)指導、咨詢、信息(xi)等服務,更好地為企業(ye)(ye)、行(xing)業(ye)(ye)提(ti)供(gong)智力(li)支撐(cheng),規范市(shi)場(chang)主體行(xing)為,引導企業(ye)(ye)健康有序發展(zhan),促進產業(ye)(ye)提(ti)質增效(xiao)升(sheng)級。

  堅(jian)持試點先行、分步穩妥推(tui)進。在(zai)中央和地(di)方分別開(kai)展(zhan)試點,設置必要的過(guo)渡(du)期,積(ji)極探索(suo),總結經驗,完善(shan)措施,逐步推(tui)開(kai)。根據行業協(xie)會商(shang)會不同情況(kuang),因地(di)因業因會逐個(ge)縝密(mi)制定脫(tuo)鉤實施方案(an),具(ju)體安排、具(ju)體指導、具(ju)體把握,確保脫(tuo)鉤工(gong)作平穩過(guo)渡(du)、有序(xu)推(tui)進。

  二(er)、脫鉤(gou)主體和范圍(wei)

  脫鉤的(de)主(zhu)(zhu)體是各級(ji)行(xing)政機(ji)關與其(qi)主(zhu)(zhu)辦(ban)、主(zhu)(zhu)管、聯系、掛靠的(de)行(xing)業協會商會。其(qi)他依照(zhao)和參照(zhao)公務員(yuan)法管理(li)的(de)單位與其(qi)主(zhu)(zhu)辦(ban)、主(zhu)(zhu)管、聯系、掛靠的(de)行(xing)業協會商會,參照(zhao)本方案執行(xing)。

  同時(shi)具有(you)以下特(te)征(zheng)的行業協會(hui)(hui)(hui)商會(hui)(hui)(hui)納(na)入脫(tuo)鉤范圍(wei):會(hui)(hui)(hui)員(yuan)主體為從事(shi)相同性質經濟活動(dong)的單位、同業人(ren)員(yuan),或同地域的經濟組織;名稱以“行業協會(hui)(hui)(hui)”、“協會(hui)(hui)(hui)”、“商會(hui)(hui)(hui)”、“同業公會(hui)(hui)(hui)”、“聯合會(hui)(hui)(hui)”、“促(cu)進會(hui)(hui)(hui)”等字(zi)樣為后綴(zhui);在民政部(bu)門登(deng)記為社會(hui)(hui)(hui)團(tuan)體法(fa)人(ren)。

  個(ge)別承擔特殊職能的全國(guo)(guo)性行(xing)業協會(hui)商會(hui),經中央辦(ban)公廳、國(guo)(guo)務院(yuan)辦(ban)公廳批準,另行(xing)制(zhi)定(ding)改革辦(ban)法。

  三、脫(tuo)鉤任務和措施

  (一(yi))機構分(fen)離,規范綜合(he)監管關系

  取消(xiao)行(xing)政(zheng)機關(guan)(包(bao)括下屬單位)與行(xing)業協(xie)會(hui)商(shang)會(hui)的主辦(ban)、主管(guan)、聯系和掛靠關(guan)系。行(xing)業協(xie)會(hui)商(shang)會(hui)依(yi)(yi)(yi)法直(zhi)接登記和獨(du)立運行(xing)。行(xing)政(zheng)機關(guan)依(yi)(yi)(yi)據(ju)職能對行(xing)業協(xie)會(hui)商(shang)會(hui)提供(gong)服務(wu)并依(yi)(yi)(yi)法監管(guan)。

  依法(fa)保障(zhang)行(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)獨立平等法(fa)人地(di)位。按照有利于行(xing)業(ye)發展(zhan)和自愿互惠原則,對行(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)之間(jian)、行(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)與(yu)其他社會(hui)(hui)(hui)(hui)組(zu)織(zhi)之間(jian)的(de)代管(guan)協(xie)管(guan)掛靠關系(xi)進行(xing)調整,并(bing)納(na)入章程予以規范。鼓(gu)勵行(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)優化整合,提高服務效率和水平。

  調整行(xing)業(ye)(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)與(yu)其代(dai)管(guan)的(de)(de)事業(ye)(ye)(ye)單位(wei)的(de)(de)關系。行(xing)業(ye)(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)代(dai)管(guan)的(de)(de)事業(ye)(ye)(ye)單位(wei),并(bing)入(ru)行(xing)業(ye)(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)的(de)(de),注銷事業(ye)(ye)(ye)單位(wei)法(fa)人(ren)資格,核銷事業(ye)(ye)(ye)編制,并(bing)入(ru)人(ren)員(yuan)按照行(xing)業(ye)(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)人(ren)員(yuan)管(guan)理(li)方式管(guan)理(li);不能(neng)并(bing)入(ru)行(xing)業(ye)(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)的(de)(de),應當(dang)與(yu)行(xing)業(ye)(ye)(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)脫鉤,根據業(ye)(ye)(ye)務(wu)關聯性,在精簡的(de)(de)基礎上劃轉到(dao)相關行(xing)業(ye)(ye)(ye)管(guan)理(li)部門管(guan)理(li),并(bing)納(na)入(ru)事業(ye)(ye)(ye)單位(wei)分類改革。

  行(xing)政機(ji)關(guan)或事業(ye)單(dan)位與行(xing)業(ye)協會(hui)商會(hui)合署辦公(gong)的(de),逐步將機(ji)構、人員和資(zi)產分開,行(xing)政機(ji)關(guan)或事業(ye)單(dan)位不再承擔行(xing)業(ye)協會(hui)商會(hui)職能。

  (二)職能分離,規范行政委托(tuo)和(he)職責分工(gong)關系

  厘清行(xing)政(zheng)(zheng)機關(guan)與行(xing)業(ye)協(xie)會商會的(de)(de)職(zhi)能。剝(bo)(bo)離行(xing)業(ye)協(xie)會商會現有(you)的(de)(de)行(xing)政(zheng)(zheng)職(zhi)能,法律(lv)法規另有(you)規定的(de)(de)除外。業(ye)務(wu)主管單位對剝(bo)(bo)離行(xing)業(ye)協(xie)會商會有(you)關(guan)行(xing)政(zheng)(zheng)職(zhi)能提出具體(ti)意(yi)見。

  加快(kuai)轉移適(shi)合由(you)行(xing)業協(xie)會(hui)商(shang)(shang)會(hui)承擔(dan)的職(zhi)能。行(xing)政機關(guan)對適(shi)合由(you)行(xing)業協(xie)會(hui)商(shang)(shang)會(hui)承擔(dan)的職(zhi)能,制定(ding)(ding)清單目(mu)錄,按程序移交行(xing)業協(xie)會(hui)商(shang)(shang)會(hui)承擔(dan),并(bing)制定(ding)(ding)監(jian)管(guan)措施、履行(xing)監(jian)管(guan)責任(ren)。

  (三(san))資產財務分離,規范財產關系

  行(xing)業協會(hui)(hui)商會(hui)(hui)應執行(xing)民間非營利組織會(hui)(hui)計制度,單(dan)獨建賬(zhang)、獨立(li)(li)(li)核算(suan)。沒有(you)獨立(li)(li)(li)賬(zhang)號(hao)、與(yu)行(xing)政機(ji)關會(hui)(hui)計合賬(zhang)、財務由行(xing)政機(ji)關代管或集中管理的(de)行(xing)業協會(hui)(hui)商會(hui)(hui),要設立(li)(li)(li)獨立(li)(li)(li)賬(zhang)號(hao),單(dan)獨核算(suan),實(shi)行(xing)獨立(li)(li)(li)財務管理。

  對原(yuan)有財(cai)政預算支(zhi)持(chi)的(de)(de)全(quan)國(guo)性行(xing)(xing)業協(xie)會(hui)商(shang)會(hui),逐(zhu)步通過政府購買服務等方(fang)(fang)式支(zhi)持(chi)其發展。自(zi)2018年(nian)起,取消全(quan)國(guo)性行(xing)(xing)業協(xie)會(hui)商(shang)會(hui)的(de)(de)財(cai)政直接撥(bo)款(kuan)(kuan),在此之前(qian),保(bao)留原(yuan)有財(cai)政撥(bo)款(kuan)(kuan)經(jing)費渠(qu)道(dao)不變。為鼓(gu)勵全(quan)國(guo)性行(xing)(xing)業協(xie)會(hui)商(shang)會(hui)加快(kuai)與行(xing)(xing)政機(ji)關脫(tuo)鉤,過渡(du)期內根(gen)據脫(tuo)鉤年(nian)份,財(cai)政直接撥(bo)款(kuan)(kuan)額度逐(zhu)年(nian)遞減。地方(fang)(fang)性行(xing)(xing)業協(xie)會(hui)商(shang)會(hui)的(de)(de)財(cai)政撥(bo)款(kuan)(kuan)過渡(du)期和過渡(du)辦法(fa),由各(ge)地自(zi)行(xing)(xing)確定,但過渡(du)期不得超(chao)過2017年(nian)底。用于安(an)置歷次政府機(ji)構(gou)改(gai)革分(fen)流(liu)人員的(de)(de)財(cai)政資金,仍按原(yuan)規定執行(xing)(xing)。

  按(an)照(zhao)財(cai)(cai)政部門、機關(guan)事務(wu)主(zhu)管部門統(tong)一部署和有(you)關(guan)規定(ding),各業(ye)務(wu)主(zhu)管單位對其主(zhu)管的(de)(de)行(xing)(xing)(xing)業(ye)協會商會財(cai)(cai)務(wu)資(zi)(zi)產(chan)狀況(kuang)進行(xing)(xing)(xing)全面摸底(di)和清(qing)查登記,厘清(qing)財(cai)(cai)產(chan)歸屬(shu)。財(cai)(cai)政部門會同機關(guan)事務(wu)主(zhu)管部門按(an)照(zhao)所有(you)權、使用(yong)權相分離的(de)(de)原(yuan)則,制定(ding)行(xing)(xing)(xing)業(ye)協會商會使用(yong)國有(you)資(zi)(zi)產(chan)(包(bao)括無形資(zi)(zi)產(chan))管理辦法,確保(bao)國有(you)資(zi)(zi)產(chan)不流失,同時確保(bao)行(xing)(xing)(xing)業(ye)協會商會的(de)(de)正常運行(xing)(xing)(xing)和發(fa)展。

  行(xing)業協會(hui)商(shang)會(hui)占用(yong)的行(xing)政辦(ban)公用(yong)房,超出(chu)規(gui)定(ding)面積標準(zhun)(zhun)的部(bu)分(fen)限期清(qing)理(li)騰退(tui);符合規(gui)定(ding)面積標準(zhun)(zhun)的部(bu)分(fen)暫由行(xing)業協會(hui)商(shang)會(hui)使用(yong),2017年(nian)底(di)前按《中(zhong)共中(zhong)央辦(ban)公廳、國(guo)務院辦(ban)公廳關(guan)(guan)于黨政機關(guan)(guan)停(ting)止新(xin)建(jian)樓堂(tang)館所和清(qing)理(li)辦(ban)公用(yong)房的通知》及有關(guan)(guan)規(gui)定(ding)清(qing)理(li)騰退(tui),原則上應實(shi)現辦(ban)公場(chang)所獨立。具(ju)體辦(ban)法由機關(guan)(guan)事務主(zhu)管(guan)部(bu)門會(hui)同(tong)有關(guan)(guan)部(bu)門制定(ding)。

  (四(si))人(ren)員管理分離,規范(fan)用(yong)人(ren)關系

  行業協會(hui)商會(hui)具有人(ren)事(shi)自主權,在人(ren)員管(guan)理上與原主辦、主管(guan)、聯系(xi)和掛靠單位脫鉤,依法(fa)依規(gui)建立規(gui)范用(yong)人(ren)制度,逐步實行依章程自主選人(ren)用(yong)人(ren)。

  行(xing)政(zheng)(zheng)機關不(bu)(bu)得推(tui)薦、安排在職(zhi)(zhi)(zhi)(zhi)和退(離(li))休(xiu)公務員(yuan)到(dao)行(xing)業協(xie)會(hui)商(shang)會(hui)任職(zhi)(zhi)(zhi)(zhi)兼(jian)(jian)職(zhi)(zhi)(zhi)(zhi)。現職(zhi)(zhi)(zhi)(zhi)和不(bu)(bu)擔任現職(zhi)(zhi)(zhi)(zhi)但未辦理(li)(li)退(離(li))休(xiu)手續(xu)的(de)黨政(zheng)(zheng)領導(dao)干(gan)(gan)部及在職(zhi)(zhi)(zhi)(zhi)工(gong)作(zuo)人員(yuan),不(bu)(bu)得在行(xing)業協(xie)會(hui)商(shang)會(hui)兼(jian)(jian)任職(zhi)(zhi)(zhi)(zhi)務。領導(dao)干(gan)(gan)部退(離(li))休(xiu)后(hou)三(san)年(nian)內一般不(bu)(bu)得到(dao)行(xing)業協(xie)會(hui)商(shang)會(hui)兼(jian)(jian)職(zhi)(zhi)(zhi)(zhi),個別確屬工(gong)作(zuo)特(te)殊需要兼(jian)(jian)職(zhi)(zhi)(zhi)(zhi)的(de),應(ying)當按照干(gan)(gan)部管理(li)(li)權限(xian)審批;退(離(li))休(xiu)三(san)年(nian)后(hou)到(dao)行(xing)業協(xie)會(hui)商(shang)會(hui)兼(jian)(jian)職(zhi)(zhi)(zhi)(zhi),須按干(gan)(gan)部管理(li)(li)權限(xian)審批或備(bei)案后(hou)方可兼(jian)(jian)職(zhi)(zhi)(zhi)(zhi)。

  對(dui)已(yi)在行(xing)業協會商會中任(ren)職(zhi)(zhi)、兼職(zhi)(zhi)的(de)公(gong)務(wu)員(yuan)(yuan),按相關(guan)規定(ding)進行(xing)一(yi)次性清理(li)。任(ren)職(zhi)(zhi)的(de)在職(zhi)(zhi)公(gong)務(wu)員(yuan)(yuan),脫鉤后自愿(yuan)選擇去留:退出行(xing)業協會商會工(gong)(gong)作的(de),由所屬行(xing)政機關(guan)妥善安置;本人自愿(yuan)繼續留在行(xing)業協會商會工(gong)(gong)作的(de),退出公(gong)務(wu)員(yuan)(yuan)管理(li),不再保留公(gong)務(wu)員(yuan)(yuan)身份(fen)。在行(xing)業協會商會兼職(zhi)(zhi)的(de)公(gong)務(wu)員(yuan)(yuan),要限期辭(ci)去兼任(ren)職(zhi)(zhi)務(wu)。

  行(xing)(xing)業(ye)協會(hui)商(shang)會(hui)全面實行(xing)(xing)勞動合(he)同(tong)制度(du),與工(gong)作(zuo)(zuo)人(ren)員簽(qian)訂勞動合(he)同(tong),依法保障工(gong)作(zuo)(zuo)人(ren)員合(he)法權益。工(gong)作(zuo)(zuo)人(ren)員的工(gong)資,由行(xing)(xing)業(ye)協會(hui)商(shang)會(hui)按照國家有關法律、法規和政策(ce)確定(ding)。行(xing)(xing)業(ye)協會(hui)商(shang)會(hui)及(ji)其工(gong)作(zuo)(zuo)人(ren)員按規定(ding)參加基本(ben)養(yang)老、基本(ben)醫療(liao)等社會(hui)保險和繳存(cun)住(zhu)房公積金。

  行業(ye)(ye)協會商會與行政(zheng)機(ji)關(guan)脫鉤(gou)后,使(shi)用(yong)的事(shi)業(ye)(ye)編制(zhi)相應核銷。現有事(shi)業(ye)(ye)人(ren)員按國家(jia)有關(guan)規定參加機(ji)關(guan)事(shi)業(ye)(ye)單位養(yang)老保(bao)險。歷次政(zheng)府機(ji)構改革分流人(ren)員仍執行原定政(zheng)策(ce)。

  (五)黨建、外事等事項分離,規范管(guan)理關(guan)系

  行(xing)(xing)(xing)(xing)業(ye)協會(hui)(hui)商(shang)會(hui)(hui)的(de)黨(dang)(dang)(dang)建(jian)(jian)(jian)、外(wai)事(shi)、人力(li)資(zi)(zi)源服務(wu)等事(shi)項與原(yuan)主辦、主管(guan)(guan)(guan)、聯(lian)系(xi)和(he)掛(gua)靠單(dan)(dan)位(wei)脫鉤。全國(guo)性行(xing)(xing)(xing)(xing)業(ye)協會(hui)(hui)商(shang)會(hui)(hui)與行(xing)(xing)(xing)(xing)政(zheng)(zheng)機(ji)(ji)關(guan)(guan)(guan)(guan)(guan)脫鉤后的(de)黨(dang)(dang)(dang)建(jian)(jian)(jian)工作,按(an)(an)照原(yuan)業(ye)務(wu)主管(guan)(guan)(guan)單(dan)(dan)位(wei)黨(dang)(dang)(dang)的(de)關(guan)(guan)(guan)(guan)(guan)系(xi)歸口分(fen)(fen)別由中(zhong)(zhong)央直屬機(ji)(ji)關(guan)(guan)(guan)(guan)(guan)工委(wei)、中(zhong)(zhong)央國(guo)家機(ji)(ji)關(guan)(guan)(guan)(guan)(guan)工委(wei)、國(guo)務(wu)院(yuan)國(guo)資(zi)(zi)委(wei)黨(dang)(dang)(dang)委(wei)領導。地方行(xing)(xing)(xing)(xing)業(ye)協會(hui)(hui)商(shang)會(hui)(hui)與行(xing)(xing)(xing)(xing)政(zheng)(zheng)機(ji)(ji)關(guan)(guan)(guan)(guan)(guan)脫鉤后的(de)黨(dang)(dang)(dang)建(jian)(jian)(jian)工作,依托各地黨(dang)(dang)(dang)委(wei)組(zu)(zu)織部(bu)門(men)和(he)民(min)(min)政(zheng)(zheng)部(bu)門(men)建(jian)(jian)(jian)立社會(hui)(hui)組(zu)(zu)織黨(dang)(dang)(dang)建(jian)(jian)(jian)工作機(ji)(ji)構(gou)(gou)統一領導;已(yi)經建(jian)(jian)(jian)立非公有(you)(you)制企業(ye)黨(dang)(dang)(dang)建(jian)(jian)(jian)工作機(ji)(ji)構(gou)(gou)的(de),可依托組(zu)(zu)織部(bu)門(men)將其與社會(hui)(hui)組(zu)(zu)織黨(dang)(dang)(dang)建(jian)(jian)(jian)工作機(ji)(ji)構(gou)(gou)整合(he)為一個機(ji)(ji)構(gou)(gou)。行(xing)(xing)(xing)(xing)業(ye)協會(hui)(hui)商(shang)會(hui)(hui)脫鉤后,外(wai)事(shi)工作由住所(suo)地省(sheng)(區、市(shi))人民(min)(min)政(zheng)(zheng)府按(an)(an)中(zhong)(zhong)央有(you)(you)關(guan)(guan)(guan)(guan)(guan)外(wai)事(shi)管(guan)(guan)(guan)理規定執(zhi)行(xing)(xing)(xing)(xing),不再(zai)經原(yuan)主辦、主管(guan)(guan)(guan)、聯(lian)系(xi)和(he)掛(gua)靠單(dan)(dan)位(wei)審批。行(xing)(xing)(xing)(xing)業(ye)協會(hui)(hui)商(shang)會(hui)(hui)主管(guan)(guan)(guan)和(he)主辦的(de)新聞出(chu)版單(dan)(dan)位(wei)的(de)業(ye)務(wu)管(guan)(guan)(guan)理,按(an)(an)照文化體制改(gai)革相關(guan)(guan)(guan)(guan)(guan)要求和(he)新聞出(chu)版行(xing)(xing)(xing)(xing)政(zheng)(zheng)管(guan)(guan)(guan)理部(bu)門(men)有(you)(you)關(guan)(guan)(guan)(guan)(guan)規定執(zhi)行(xing)(xing)(xing)(xing)。人力(li)資(zi)(zi)源服務(wu)等事(shi)項由行(xing)(xing)(xing)(xing)業(ye)協會(hui)(hui)商(shang)會(hui)(hui)住所(suo)地有(you)(you)關(guan)(guan)(guan)(guan)(guan)部(bu)門(men)按(an)(an)職能分(fen)(fen)工承擔。

  四、配套政(zheng)策

  (一)完善支持政策(ce)

  制定(ding)有(you)針對性的扶持引導政(zheng)策,加強(qiang)分類指導。完善(shan)政(zheng)府購買服務(wu)機(ji)制,支持行(xing)業協會(hui)商會(hui)轉型發(fa)展(zhan)。鼓(gu)勵各有(you)關部門按照《國(guo)務(wu)院辦(ban)公廳(ting)關于政(zheng)府向社會(hui)力量購買服務(wu)的指導意(yi)見》要(yao)求,向符合條件(jian)的行(xing)業協會(hui)商會(hui)和其他(ta)社會(hui)力量購買服務(wu),及時公布購買服務(wu)事項和相關信(xin)息,加強(qiang)績效(xiao)管理。

  完善(shan)行(xing)業(ye)(ye)協(xie)會商會價(jia)格政策(ce),落(luo)實有關(guan)(guan)稅收政策(ce)。按照行(xing)政事業(ye)(ye)性(xing)收費(fei)管(guan)理的有關(guan)(guan)規(gui)定,規(gui)范行(xing)業(ye)(ye)協(xie)會商會承接政府(fu)委(wei)托(tuo)的行(xing)政事業(ye)(ye)性(xing)收費(fei)事項。對符(fu)合條(tiao)件的非(fei)營利組織(zhi)落(luo)實企業(ye)(ye)所得(de)稅優惠(hui)政策(ce)。

  鼓勵行(xing)業(ye)(ye)協會(hui)商會(hui)參與制定相關立法(fa)、政府規(gui)劃、公共政策(ce)、行(xing)業(ye)(ye)標準和行(xing)業(ye)(ye)數據統計(ji)等事(shi)務。有關部門要充分發揮行(xing)業(ye)(ye)協會(hui)商會(hui)在行(xing)業(ye)(ye)指(zhi)南制定、行(xing)業(ye)(ye)人才培養(yang)、共性技(ji)術平(ping)臺(tai)建(jian)設、第三方咨詢評估等方面作用,完善對(dui)行(xing)業(ye)(ye)協會(hui)商會(hui)服務創新能力(li)建(jian)設的支持機制。

  建立信(xin)息(xi)資源(yuan)共享機制(zhi)(zhi)。全國(guo)性行(xing)(xing)業(ye)協(xie)會(hui)(hui)商(shang)會(hui)(hui)的有關(guan)(guan)行(xing)(xing)業(ye)統計數據(ju)(ju),按原規定(ding)報送國(guo)家統計局。行(xing)(xing)業(ye)協(xie)會(hui)(hui)商(shang)會(hui)(hui)應按原渠道(dao)向(xiang)行(xing)(xing)業(ye)管理部(bu)門(men)報送相關(guan)(guan)行(xing)(xing)業(ye)數據(ju)(ju)和(he)(he)信(xin)息(xi)。有關(guan)(guan)職能部(bu)門(men)要(yao)建立行(xing)(xing)業(ye)公共信(xin)息(xi)交匯(hui)平臺,整合全國(guo)性行(xing)(xing)業(ye)協(xie)會(hui)(hui)商(shang)會(hui)(hui)的有關(guan)(guan)數據(ju)(ju),為政府(fu)制(zhi)(zhi)定(ding)和(he)(he)實施相關(guan)(guan)政策(ce)提供信(xin)息(xi)服務(wu),為行(xing)(xing)業(ye)協(xie)會(hui)(hui)商(shang)會(hui)(hui)提供必(bi)要(yao)的行(xing)(xing)業(ye)信(xin)息(xi)和(he)(he)數據(ju)(ju)。

  支持行業(ye)(ye)協(xie)會(hui)(hui)商會(hui)(hui)在進出口貿易(yi)和(he)對(dui)(dui)外(wai)經濟交流(liu)、企業(ye)(ye)“走出去”、應(ying)對(dui)(dui)貿易(yi)摩擦等(deng)事務(wu)中,發揮協(xie)調、指導、咨詢(xun)、服務(wu)作用。鼓勵行業(ye)(ye)協(xie)會(hui)(hui)商會(hui)(hui)參與協(xie)助政(zheng)府部(bu)門(men)多雙(shuang)邊(bian)經貿談判(pan)工作,提供相關(guan)咨詢(xun)和(he)協(xie)調服務(wu)。鼓勵行業(ye)(ye)協(xie)會(hui)(hui)商會(hui)(hui)積極搭建促進對(dui)(dui)外(wai)貿易(yi)和(he)投資等(deng)服務(wu)平臺,幫助企業(ye)(ye)開拓國際市場。

  (二)完善綜合監管(guan)體制(zhi)

  加強法律法規(gui)制度建設。加快推進(jin)行業(ye)協(xie)會(hui)(hui)商會(hui)(hui)立(li)法工作。行業(ye)協(xie)會(hui)(hui)商會(hui)(hui)脫(tuo)鉤后,按(an)程(cheng)序修改章(zhang)程(cheng)并報民政部門備案。健全行業(ye)協(xie)會(hui)(hui)商會(hui)(hui)退出機制,在實施(shi)脫(tuo)鉤中對職能不清(qing)、業(ye)務開(kai)展不正常、不適應經濟社(she)會(hui)(hui)發展的行業(ye)協(xie)會(hui)(hui)商會(hui)(hui)依法予(yu)以注銷。鼓勵和促(cu)進(jin)行業(ye)協(xie)會(hui)(hui)商會(hui)(hui)間公平有序競爭。

  完善政(zheng)(zheng)(zheng)府(fu)綜(zong)合(he)監(jian)(jian)管(guan)(guan)體系。制定行(xing)業(ye)(ye)(ye)協會(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)綜(zong)合(he)監(jian)(jian)管(guan)(guan)辦法,健全監(jian)(jian)督(du)(du)管(guan)(guan)理(li)機(ji)制。民政(zheng)(zheng)(zheng)部門(men)(men)(men)依照相關登記管(guan)(guan)理(li)法規,對(dui)(dui)(dui)行(xing)業(ye)(ye)(ye)協會(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)加強登記審查(cha)、監(jian)(jian)督(du)(du)管(guan)(guan)理(li)和(he)(he)執法檢查(cha),強化對(dui)(dui)(dui)主要負(fu)責人任(ren)職(zhi)條件和(he)(he)任(ren)用(yong)程序的(de)監(jian)(jian)督(du)(du)管(guan)(guan)理(li)。財(cai)政(zheng)(zheng)(zheng)部門(men)(men)(men)負(fu)責對(dui)(dui)(dui)政(zheng)(zheng)(zheng)府(fu)購(gou)買行(xing)業(ye)(ye)(ye)協會(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)服務(wu)(wu)的(de)資金和(he)(he)行(xing)為進(jin)行(xing)評估和(he)(he)監(jian)(jian)管(guan)(guan),并(bing)會(hui)(hui)(hui)(hui)(hui)同機(ji)關事(shi)務(wu)(wu)主管(guan)(guan)部門(men)(men)(men)對(dui)(dui)(dui)行(xing)業(ye)(ye)(ye)協會(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)使用(yong)的(de)國有資產(chan)進(jin)行(xing)登記和(he)(he)監(jian)(jian)管(guan)(guan)。稅務(wu)(wu)部門(men)(men)(men)對(dui)(dui)(dui)行(xing)業(ye)(ye)(ye)協會(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)涉稅行(xing)為進(jin)行(xing)稽查(cha)和(he)(he)監(jian)(jian)管(guan)(guan)。審計部門(men)(men)(men)對(dui)(dui)(dui)行(xing)業(ye)(ye)(ye)協會(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)依法進(jin)行(xing)審計監(jian)(jian)督(du)(du)。價(jia)格(ge)部門(men)(men)(men)對(dui)(dui)(dui)行(xing)業(ye)(ye)(ye)協會(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)收費(fei)及(ji)價(jia)格(ge)行(xing)為進(jin)行(xing)監(jian)(jian)管(guan)(guan)。行(xing)業(ye)(ye)(ye)協會(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)組織論壇、評比、達標、表彰等(deng)活(huo)動(dong),要嚴格(ge)按(an)相關規定執行(xing),并(bing)接(jie)受監(jian)(jian)督(du)(du)。各行(xing)業(ye)(ye)(ye)管(guan)(guan)理(li)部門(men)(men)(men)按(an)職(zhi)能(neng)對(dui)(dui)(dui)行(xing)業(ye)(ye)(ye)協會(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)進(jin)行(xing)政(zheng)(zheng)(zheng)策(ce)和(he)(he)業(ye)(ye)(ye)務(wu)(wu)指導,并(bing)履(lv)行(xing)相關監(jian)(jian)管(guan)(guan)責任(ren)。其(qi)他職(zhi)能(neng)部門(men)(men)(men)和(he)(he)地方政(zheng)(zheng)(zheng)府(fu)按(an)職(zhi)能(neng)分工對(dui)(dui)(dui)行(xing)業(ye)(ye)(ye)協會(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)進(jin)行(xing)監(jian)(jian)管(guan)(guan)。黨(dang)的(de)各級紀檢機(ji)關加強監(jian)(jian)督(du)(du)執紀問責。探索建立專業(ye)(ye)(ye)化、社(she)會(hui)(hui)(hui)(hui)(hui)化的(de)第三(san)方監(jian)(jian)督(du)(du)機(ji)制。

  完善信(xin)(xin)(xin)用(yong)體系和信(xin)(xin)(xin)息公(gong)開(kai)(kai)制(zhi)度(du)。建(jian)立(li)行(xing)(xing)業協(xie)會(hui)(hui)商(shang)會(hui)(hui)信(xin)(xin)(xin)用(yong)承(cheng)諾制(zhi)度(du),完善行(xing)(xing)業協(xie)會(hui)(hui)商(shang)會(hui)(hui)的(de)信(xin)(xin)(xin)用(yong)記錄,建(jian)立(li)綜合信(xin)(xin)(xin)用(yong)評(ping)級制(zhi)度(du)。對行(xing)(xing)業協(xie)會(hui)(hui)商(shang)會(hui)(hui)的(de)信(xin)(xin)(xin)用(yong)情況開(kai)(kai)展社會(hui)(hui)評(ping)價(jia)(jia),評(ping)價(jia)(jia)結果向社會(hui)(hui)公(gong)布。建(jian)立(li)健(jian)全行(xing)(xing)業協(xie)會(hui)(hui)商(shang)會(hui)(hui)信(xin)(xin)(xin)息公(gong)開(kai)(kai)和年度(du)報告制(zhi)度(du),接受社會(hui)(hui)監(jian)督。

  建立(li)(li)(li)完善(shan)法(fa)人(ren)治理(li)結構(gou)。行(xing)業(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)要按照建立(li)(li)(li)現代(dai)社(she)會(hui)(hui)(hui)組織要求,建立(li)(li)(li)和完善(shan)產(chan)權清(qing)晰、權責(ze)明確、運轉協(xie)(xie)調、制(zhi)(zhi)(zhi)(zhi)衡有(you)效(xiao)的法(fa)人(ren)治理(li)結構(gou)。健全(quan)(quan)行(xing)業(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)章程審核備案機(ji)制(zhi)(zhi)(zhi)(zhi),完善(shan)以章程為核心(xin)的內部管(guan)理(li)制(zhi)(zhi)(zhi)(zhi)度,健全(quan)(quan)會(hui)(hui)(hui)員(yuan)大會(hui)(hui)(hui)(會(hui)(hui)(hui)員(yuan)代(dai)表大會(hui)(hui)(hui))、理(li)事(shi)會(hui)(hui)(hui)(常務理(li)事(shi)會(hui)(hui)(hui))制(zhi)(zhi)(zhi)(zhi)度,建立(li)(li)(li)和健全(quan)(quan)監(jian)事(shi)會(hui)(hui)(hui)(監(jian)事(shi))制(zhi)(zhi)(zhi)(zhi)度。落實民主(zhu)選(xuan)舉、差額選(xuan)舉和無記名投票(piao)制(zhi)(zhi)(zhi)(zhi)度。鼓勵選(xuan)舉企(qi)業(ye)家擔(dan)任(ren)行(xing)業(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)理(li)事(shi)長(chang)(chang),探(tan)索實行(xing)理(li)事(shi)長(chang)(chang)(會(hui)(hui)(hui)長(chang)(chang))輪(lun)值制(zhi)(zhi)(zhi)(zhi),推行(xing)秘(mi)書長(chang)(chang)聘任(ren)制(zhi)(zhi)(zhi)(zhi)。實施法(fa)定代(dai)表人(ren)述職、主(zhu)要負責(ze)人(ren)任(ren)職前(qian)公示和過錯責(ze)任(ren)追究制(zhi)(zhi)(zhi)(zhi)度。在(zai)重要的行(xing)業(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)試行(xing)委派(pai)監(jian)事(shi)制(zhi)(zhi)(zhi)(zhi)度,委派(pai)監(jian)事(shi)履行(xing)監(jian)督和指導(dao)職責(ze),督促行(xing)業(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)落實宏觀調控政策和行(xing)業(ye)政策。所(suo)派(pai)監(jian)事(shi)不在(zai)行(xing)業(ye)協(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)兼職、取酬(chou)、享受福利。

  五(wu)、組織實施(shi)

  (一)建立(li)工作機制

  國(guo)家發展改(gai)革委(wei)、民政部(bu)會(hui)同(tong)中(zhong)央組織部(bu)、中(zhong)央編辦、中(zhong)央直屬機關(guan)工(gong)(gong)(gong)委(wei)、中(zhong)央國(guo)家機關(guan)工(gong)(gong)(gong)委(wei)、外交(jiao)部(bu)、工(gong)(gong)(gong)業和(he)(he)信息(xi)化(hua)部(bu)、財(cai)政部(bu)、人力資(zi)源社會(hui)保障部(bu)、商務部(bu)、審計署、國(guo)務院國(guo)資(zi)委(wei)、國(guo)管局、全國(guo)工(gong)(gong)(gong)商聯,成立(li)行業協(xie)會(hui)商會(hui)與行政機關(guan)脫鉤聯合工(gong)(gong)(gong)作(zuo)(zuo)組(以下簡稱(cheng)聯合工(gong)(gong)(gong)作(zuo)(zuo)組),負責(ze)組織實(shi)施本方案,推進全國(guo)性(xing)行業協(xie)會(hui)商會(hui)脫鉤工(gong)(gong)(gong)作(zuo)(zuo),指導和(he)(he)督促各地(di)(di)開(kai)展脫鉤工(gong)(gong)(gong)作(zuo)(zuo)。聯合工(gong)(gong)(gong)作(zuo)(zuo)組由國(guo)務院領(ling)導同(tong)志牽頭,辦公室設在國(guo)家發展改(gai)革委(wei)。各地(di)(di)建(jian)立(li)相(xiang)應領(ling)導機制(zhi)和(he)(he)工(gong)(gong)(gong)作(zuo)(zuo)組,制(zhi)定本地(di)(di)區脫鉤方案,負責(ze)推進本地(di)(di)區脫鉤工(gong)(gong)(gong)作(zuo)(zuo)。

  (二)明確責(ze)任分工

  各(ge)(ge)相關(guan)職能部門(men)按照本方案(an)(an)和職能分工,落實(shi)(shi)相關(guan)政策和措施(shi)。各(ge)(ge)級(ji)發(fa)展改(gai)革、民政部門(men)負(fu)(fu)責統籌協調、督(du)促檢查脫鉤(gou)工作。審(shen)計(ji)部門(men)負(fu)(fu)責對資產清查結(jie)果進(jin)行(xing)抽查監督(du),審(shen)計(ji)脫鉤(gou)過程中財政資金使用(yong)情況。各(ge)(ge)業務主(zhu)管單位(wei)負(fu)(fu)責逐個制定行(xing)業協會(hui)商會(hui)脫鉤(gou)實(shi)(shi)施(shi)方案(an)(an),落實(shi)(shi)各(ge)(ge)項工作,并(bing)向社會(hui)公開。

  本方案(an)印發后(hou)一個月(yue)內,有關(guan)(guan)部(bu)(bu)門分(fen)別出(chu)臺(tai)相關(guan)(guan)配套(tao)文件:中(zhong)央組(zu)織部(bu)(bu)會(hui)(hui)(hui)同(tong)(tong)中(zhong)央直屬機關(guan)(guan)工(gong)(gong)委(wei)、中(zhong)央國(guo)(guo)(guo)(guo)家(jia)機關(guan)(guan)工(gong)(gong)委(wei)、國(guo)(guo)(guo)(guo)務院(yuan)國(guo)(guo)(guo)(guo)資委(wei)黨委(wei)制(zhi)(zhi)定(ding)(ding)關(guan)(guan)于(yu)全國(guo)(guo)(guo)(guo)性行(xing)(xing)(xing)業(ye)協會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)與行(xing)(xing)(xing)政(zheng)(zheng)(zheng)機關(guan)(guan)脫(tuo)鉤(gou)后(hou)黨建工(gong)(gong)作管(guan)理(li)體制(zhi)(zhi)調(diao)整的(de)(de)實施(shi)辦(ban)法(fa),明確黨的(de)(de)思想、組(zu)織、作風、反(fan)腐倡廉和制(zhi)(zhi)度建設的(de)(de)具體任務,切實加強黨對行(xing)(xing)(xing)業(ye)協會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)黨建工(gong)(gong)作的(de)(de)領導;中(zhong)央編辦(ban)會(hui)(hui)(hui)同(tong)(tong)國(guo)(guo)(guo)(guo)家(jia)發展(zhan)(zhan)改(gai)(gai)革(ge)委(wei)、工(gong)(gong)業(ye)和信(xin)息(xi)化部(bu)(bu)、財(cai)政(zheng)(zheng)(zheng)部(bu)(bu)、人(ren)力資源社會(hui)(hui)(hui)保障(zhang)部(bu)(bu)、商(shang)(shang)務部(bu)(bu)、國(guo)(guo)(guo)(guo)務院(yuan)國(guo)(guo)(guo)(guo)資委(wei)等(deng)部(bu)(bu)門提(ti)出(chu)關(guan)(guan)于(yu)行(xing)(xing)(xing)業(ye)協會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)與行(xing)(xing)(xing)政(zheng)(zheng)(zheng)機關(guan)(guan)脫(tuo)鉤(gou)涉(she)及事業(ye)單位機構編制(zhi)(zhi)調(diao)整的(de)(de)意見;外交部(bu)(bu)提(ti)出(chu)相關(guan)(guan)外事管(guan)理(li)工(gong)(gong)作政(zheng)(zheng)(zheng)策措施(shi);國(guo)(guo)(guo)(guo)家(jia)發展(zhan)(zhan)改(gai)(gai)革(ge)委(wei)牽(qian)頭制(zhi)(zhi)定(ding)(ding)行(xing)(xing)(xing)業(ye)公共信(xin)息(xi)平臺(tai)建設方案(an);民政(zheng)(zheng)(zheng)部(bu)(bu)牽(qian)頭制(zhi)(zhi)定(ding)(ding)全國(guo)(guo)(guo)(guo)性行(xing)(xing)(xing)業(ye)協會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)主要負責(ze)人(ren)任職管(guan)理(li)辦(ban)法(fa);財(cai)政(zheng)(zheng)(zheng)部(bu)(bu)會(hui)(hui)(hui)同(tong)(tong)國(guo)(guo)(guo)(guo)管(guan)局(ju)(ju)、中(zhong)直管(guan)理(li)局(ju)(ju)等(deng)有關(guan)(guan)部(bu)(bu)門制(zhi)(zhi)定(ding)(ding)行(xing)(xing)(xing)業(ye)協會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)資產清(qing)(qing)查和國(guo)(guo)(guo)(guo)有資產管(guan)理(li)規定(ding)(ding),財(cai)政(zheng)(zheng)(zheng)部(bu)(bu)提(ti)出(chu)逐步取消財(cai)政(zheng)(zheng)(zheng)撥款的(de)(de)具體操作辦(ban)法(fa),財(cai)政(zheng)(zheng)(zheng)部(bu)(bu)會(hui)(hui)(hui)同(tong)(tong)國(guo)(guo)(guo)(guo)家(jia)發展(zhan)(zhan)改(gai)(gai)革(ge)委(wei)等(deng)部(bu)(bu)門提(ti)出(chu)購買行(xing)(xing)(xing)業(ye)協會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)服務的(de)(de)具體措施(shi);國(guo)(guo)(guo)(guo)管(guan)局(ju)(ju)、中(zhong)直管(guan)理(li)局(ju)(ju)會(hui)(hui)(hui)同(tong)(tong)有關(guan)(guan)部(bu)(bu)門制(zhi)(zhi)定(ding)(ding)清(qing)(qing)理(li)騰(teng)退全國(guo)(guo)(guo)(guo)性行(xing)(xing)(xing)業(ye)協會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)占用(yong)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)辦(ban)公用(yong)房的(de)(de)具體辦(ban)法(fa)。

  為適應行業協(xie)會(hui)(hui)商會(hui)(hui)脫鉤后(hou)的新體制(zhi)新要求,國家發展改革委、民政部會(hui)(hui)同有關部門制(zhi)定綜合監管辦法。

  (三)穩妥(tuo)開展試點(dian)

  全(quan)國(guo)性(xing)行(xing)(xing)業(ye)協會商(shang)會脫(tuo)(tuo)鉤(gou)試(shi)(shi)點(dian)(dian)(dian)(dian)工(gong)(gong)作(zuo)(zuo)由民(min)政部(bu)牽頭負責,2015年(nian)(nian)下半年(nian)(nian)開始第一批(pi)(pi)試(shi)(shi)點(dian)(dian)(dian)(dian),2016年(nian)(nian)總結經(jing)驗、擴大試(shi)(shi)點(dian)(dian)(dian)(dian),2017年(nian)(nian)在(zai)更大范圍試(shi)(shi)點(dian)(dian)(dian)(dian),通過試(shi)(shi)點(dian)(dian)(dian)(dian)完善相(xiang)應的(de)(de)體制機制后全(quan)面推開。按照兼顧不同(tong)類型、行(xing)(xing)業(ye)和(he)部(bu)門的(de)(de)原(yuan)則,第一批(pi)(pi)選擇100個(ge)左右全(quan)國(guo)性(xing)行(xing)(xing)業(ye)協會商(shang)會開展(zhan)脫(tuo)(tuo)鉤(gou)試(shi)(shi)點(dian)(dian)(dian)(dian)。各(ge)業(ye)務主管(guan)單(dan)位于2015年(nian)(nian)7月(yue)底(di)前(qian)將推薦(jian)試(shi)(shi)點(dian)(dian)(dian)(dian)名(ming)單(dan)報(bao)(bao)送民(min)政部(bu),并逐個(ge)制定試(shi)(shi)點(dian)(dian)(dian)(dian)行(xing)(xing)業(ye)協會商(shang)會脫(tuo)(tuo)鉤(gou)實施方案(an)(an)。方案(an)(an)報(bao)(bao)經(jing)民(min)政部(bu)核準(zhun)、聯合(he)工(gong)(gong)作(zuo)(zuo)組(zu)批(pi)(pi)復(fu)后實施,其中須有關部(bu)門批(pi)(pi)準(zhun)的(de)(de)事項,按管(guan)理權限和(he)職能分(fen)別(bie)報(bao)(bao)批(pi)(pi)。各(ge)試(shi)(shi)點(dian)(dian)(dian)(dian)單(dan)位要在(zai)2016年(nian)(nian)6月(yue)底(di)前(qian)完成(cheng)第一批(pi)(pi)試(shi)(shi)點(dian)(dian)(dian)(dian),由聯合(he)工(gong)(gong)作(zuo)(zuo)組(zu)對(dui)試(shi)(shi)點(dian)(dian)(dian)(dian)成(cheng)效(xiao)進(jin)行(xing)(xing)評估并認真總結經(jing)驗,完善配套(tao)政策(ce)。

  地(di)方行業協會(hui)商會(hui)脫(tuo)鉤試(shi)(shi)(shi)點(dian)(dian)工(gong)作由各(ge)省(區、市)工(gong)作組(zu)負責(ze)。各(ge)省(區、市)同步開展本地(di)區脫(tuo)鉤試(shi)(shi)(shi)點(dian)(dian)工(gong)作,首先選擇幾個省一(yi)級(ji)協會(hui)開展試(shi)(shi)(shi)點(dian)(dian),試(shi)(shi)(shi)點(dian)(dian)方案報(bao)經民政部核準、聯合工(gong)作組(zu)批復后實施。各(ge)地(di)要在2016年底前完成(cheng)第(di)一(yi)批試(shi)(shi)(shi)點(dian)(dian)和(he)評估,并將評估結果(guo)報(bao)聯合工(gong)作組(zu)。在認(ren)真總(zong)結經驗的(de)基礎上,完善(shan)試(shi)(shi)(shi)點(dian)(dian)政策,逐步擴大試(shi)(shi)(shi)點(dian)(dian)范圍,穩妥審(shen)慎推(tui)開。

  (四)精心(xin)組織實(shi)施

  脫(tuo)(tuo)鉤工(gong)(gong)(gong)作(zuo)(zuo)(zuo)涉及(ji)面廣(guang)、政(zheng)策性強、社會關(guan)注度(du)高(gao),各地區(qu)、各有關(guan)部門和(he)行(xing)業協(xie)會商(shang)會要(yao)(yao)高(gao)度(du)重視,嚴明紀律,做好(hao)風險預案(an),確保(bao)如期完成脫(tuo)(tuo)鉤任務。要(yao)(yao)嚴格按照本方案(an)要(yao)(yao)求推進脫(tuo)(tuo)鉤工(gong)(gong)(gong)作(zuo)(zuo)(zuo),規(gui)范工(gong)(gong)(gong)作(zuo)(zuo)(zuo)程序,建立考核機制,確保(bao)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)有序開展。要(yao)(yao)加(jia)強輿論(lun)引導和(he)政(zheng)策解讀,形(xing)成良好(hao)輿論(lun)氛圍(wei)。脫(tuo)(tuo)鉤工(gong)(gong)(gong)作(zuo)(zuo)(zuo)中遇有重要(yao)(yao)情況和(he)問題,要(yao)(yao)及(ji)時向聯合(he)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)組報告。

  各(ge)地區、各(ge)部門(men)要大力支持(chi)行(xing)業(ye)(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)發展(zhan),優(you)化發展(zhan)環境,改進(jin)工作(zuo)方式,構(gou)建與行(xing)業(ye)(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)新(xin)型(xing)合作(zuo)關(guan)系(xi);建立(li)和(he)(he)完善與行(xing)業(ye)(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)協(xie)(xie)(xie)商(shang)(shang)機制,在研(yan)究重大問題和(he)(he)制定(ding)相(xiang)關(guan)法律法規(gui)、規(gui)劃(hua)、政策時應(ying)主動(dong)聽取相(xiang)關(guan)行(xing)業(ye)(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)意見;加(jia)(jia)強對(dui)行(xing)業(ye)(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)的指導(dao)和(he)(he)支持(chi),及時研(yan)究解(jie)決行(xing)業(ye)(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)改革發展(zhan)中的困難和(he)(he)問題。行(xing)業(ye)(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)(hui)(hui)要加(jia)(jia)快(kuai)轉型(xing),努力適應(ying)新(xin)常態、新(xin)規(gui)則(ze)、新(xin)要求,完善治(zhi)理結構(gou),規(gui)范自身行(xing)為,提升專業(ye)(ye)服(fu)務水平,強化行(xing)業(ye)(ye)自律,引導(dao)企業(ye)(ye)規(gui)范經營,積極反映會(hui)(hui)(hui)(hui)(hui)員訴求,維(wei)護會(hui)(hui)(hui)(hui)(hui)員合法權益,真(zhen)正成為依(yi)法自治(zhi)的現代社會(hui)(hui)(hui)(hui)(hui)組織(zhi)。
