新環保法實施中存在哪些瓶頸?

  2015年新(xin)《環保(bao)法》的實施,必將進(jin)一步增強政府的環保(bao)主體責(ze)任(ren)(ren)、環保(bao)部(bu)門的統一監(jian)管(guan)責(ze)任(ren)(ren)、企業的治污責(ze)任(ren)(ren)、公眾的監(jian)督責(ze)任(ren)(ren),有力地保(bao)障我國(guo)環保(bao)事業的健(jian)康發展。但新(xin)《環保(bao)法》實施中,仍然存在一些難點和(he)瓶頸,需要加以(yi)思考和(he)解決。

  新法實施中面臨的主要瓶頸

  地方(fang)政(zheng)府(fu)(fu)(fu)的(de)(de)(de)環(huan)保主體(ti)責(ze)任(ren)凸顯不夠(gou)。新《環(huan)保法》第六條(tiao)規定:地方(fang)各級人民(min)政(zheng)府(fu)(fu)(fu)應(ying)當對(dui)(dui)本(ben)(ben)行政(zheng)區域的(de)(de)(de)環(huan)境(jing)質(zhi)量負責(ze)。這明確界定了地方(fang)政(zheng)府(fu)(fu)(fu)的(de)(de)(de)環(huan)保主體(ti)責(ze)任(ren)。目(mu)前(qian),雖(sui)然地方(fang)各級政(zheng)府(fu)(fu)(fu)的(de)(de)(de)環(huan)境(jing)意識(shi)有(you)(you)(you)了不同程度的(de)(de)(de)提高,但是一(yi)些(xie)地方(fang)政(zheng)府(fu)(fu)(fu)不能正確處理環(huan)保與發展(zhan)的(de)(de)(de)關(guan)系(xi),認(ren)為經濟(ji)發展(zhan)是硬(ying)任(ren)務,環(huan)境(jing)保護是軟指標(biao),一(yi)旦環(huan)保與發展(zhan)出(chu)現矛盾時往往舍棄環(huan)保。雖(sui)然中央提出(chu)對(dui)(dui)領導干部(bu)實行生態環(huan)境(jing)損(sun)害責(ze)任(ren)終身(shen)追究制,離任(ren)時要有(you)(you)(you)自然資(zi)源資(zi)產離任(ren)審計(ji),但因目(mu)前(qian)尚(shang)未(wei)出(chu)臺實施細則而難以(yi)落(luo)實;對(dui)(dui)有(you)(you)(you)的(de)(de)(de)領導干部(bu)本(ben)(ben)應(ying)追究環(huan)保責(ze)任(ren),也因無相應(ying)追責(ze)制度而不了了之(zhi)。

  環(huan)(huan)(huan)保(bao)(bao)部(bu)門(men)統(tong)一(yi)監督管(guan)(guan)(guan)理(li)難(nan)度(du)大。一(yi)是(shi)在(zai)(zai)職(zhi)(zhi)能(neng)定位上(shang),地(di)方政府對環(huan)(huan)(huan)保(bao)(bao)部(bu)門(men)定位千差萬別。二是(shi)在(zai)(zai)監管(guan)(guan)(guan)體制(zhi)(zhi)上(shang),環(huan)(huan)(huan)保(bao)(bao)部(bu)門(men)平行于(yu)其他部(bu)門(men),甚至被視作弱(ruo)勢部(bu)門(men)。三(san)是(shi)在(zai)(zai)監管(guan)(guan)(guan)職(zhi)(zhi)能(neng)上(shang),除環(huan)(huan)(huan)境保(bao)(bao)護部(bu)環(huan)(huan)(huan)監局(ju)及少數地(di)方環(huan)(huan)(huan)監部(bu)門(men)為(wei)公務(wu)員編(bian)制(zhi)(zhi)外,各(ge)地(di)環(huan)(huan)(huan)監部(bu)門(men)均為(wei)事業編(bian)制(zhi)(zhi)或參公管(guan)(guan)(guan)理(li)事業編(bian)制(zhi)(zhi)。四是(shi)在(zai)(zai)監管(guan)(guan)(guan)能(neng)力(li)上(shang),部(bu)分地(di)方以環(huan)(huan)(huan)境監察執(zhi)法(fa)(fa)未納入國務(wu)院正式批準(zhun)的執(zhi)法(fa)(fa)序列為(wei)由,將基層環(huan)(huan)(huan)境執(zhi)法(fa)(fa)車(che)輛收回,執(zhi)法(fa)(fa)裝備配備也十分有限。五是(shi)在(zai)(zai)監管(guan)(guan)(guan)力(li)度(du)上(shang),一(yi)些基層環(huan)(huan)(huan)保(bao)(bao)部(bu)門(men)由于(yu)主客觀(guan)原因,監管(guan)(guan)(guan)執(zhi)法(fa)(fa)的力(li)度(du)依然偏軟。

  有(you)關(guan)部(bu)(bu)(bu)門(men)環(huan)(huan)(huan)(huan)保(bao)(bao)監(jian)督(du)管理(li)未形成合力。新(xin)《環(huan)(huan)(huan)(huan)保(bao)(bao)法》第十條規定:縣(xian)級以上人(ren)民政府有(you)關(guan)部(bu)(bu)(bu)門(men)和軍隊環(huan)(huan)(huan)(huan)境保(bao)(bao)護部(bu)(bu)(bu)門(men),依照有(you)關(guan)法律的(de)規定對資源保(bao)(bao)護和污染防治等環(huan)(huan)(huan)(huan)境保(bao)(bao)護工作實施(shi)監(jian)督(du)管理(li)。這(zhe)明(ming)確界(jie)定了(le)政府有(you)關(guan)部(bu)(bu)(bu)門(men)擔(dan)負環(huan)(huan)(huan)(huan)保(bao)(bao)監(jian)管的(de)法定職責(ze)(ze)。2014年華(hua)北(bei)環(huan)(huan)(huan)(huan)保(bao)(bao)督(du)查(cha)中(zhong)心對華(hua)北(bei)地(di)區14個重(zhong)點城市(區)開展了(le)以督(du)政為(wei)導向的(de)環(huan)(huan)(huan)(huan)保(bao)(bao)綜合督(du)查(cha),對有(you)關(guan)部(bu)(bu)(bu)門(men)開展了(le)調研走訪,發(fa)現主要存在(zai)職責(ze)(ze)不清、不愿擔(dan)當、被動應付(fu)、推卸責(ze)(ze)任等問題(ti)。一旦出現問題(ti),便將責(ze)(ze)任推至環(huan)(huan)(huan)(huan)保(bao)(bao)部(bu)(bu)(bu)門(men),地(di)方政府追責(ze)(ze)時環(huan)(huan)(huan)(huan)保(bao)(bao)部(bu)(bu)(bu)門(men)往往首當其沖。

  一些企事業單位(wei)守(shou)法(fa)自覺(jue)(jue)性不(bu)(bu)高。新《環(huan)(huan)保(bao)法(fa)》第(di)六條規(gui)定:企業事業單位(wei)和其他生(sheng)產(chan)經營者(zhe)應當(dang)防止、減少(shao)環(huan)(huan)境污染和生(sheng)態破壞,對所(suo)造成(cheng)的(de)(de)損害依法(fa)承擔(dan)責(ze)任。目前環(huan)(huan)境違(wei)(wei)法(fa)行(xing)(xing)為(wei)(wei)仍(reng)然多發(fa),其根源(yuan)是(shi)一些企事業單位(wei)守(shou)法(fa)的(de)(de)自覺(jue)(jue)性不(bu)(bu)高,主要(yao)表現在:一是(shi)不(bu)(bu)知而犯,尤其是(shi)小企業主的(de)(de)環(huan)(huan)境常識(shi)不(bu)(bu)足、環(huan)(huan)境意識(shi)低下(xia),對環(huan)(huan)境違(wei)(wei)法(fa)渾然不(bu)(bu)覺(jue)(jue),對違(wei)(wei)法(fa)排(pai)污行(xing)(xing)為(wei)(wei)司空見(jian)慣,不(bu)(bu)以為(wei)(wei)違(wei)(wei)法(fa);二是(shi)明知故犯,不(bu)(bu)少(shao)企業仍(reng)抱有僥幸心理(li),尤其是(shi)企業在經濟效益不(bu)(bu)好的(de)(de)情(qing)況下(xia),為(wei)(wei)獲得利潤想方設(she)法(fa)逃(tao)避(bi)監管(guan);三是(shi)惡意違(wei)(wei)法(fa),為(wei)(wei)追求效益,在環(huan)(huan)保(bao)設(she)施(shi)上(shang)做文章,不(bu)(bu)上(shang)環(huan)(huan)保(bao)設(she)施(shi),或者(zhe)上(shang)了設(she)施(shi)也不(bu)(bu)能正常運行(xing)(xing),運行(xing)(xing)起(qi)來又不(bu)(bu)能達(da)標排(pai)放。對此,增強(qiang)企事業單位(wei)守(shou)法(fa)的(de)(de)自覺(jue)(jue)性,無(wu)疑(yi)是(shi)當(dang)前最為(wei)(wei)迫切的(de)(de)任務之一。

  公(gong)眾(zhong)(zhong)履(lv)行(xing)環(huan)(huan)(huan)(huan)(huan)保義務(wu)(wu)不(bu)(bu)到位。隨(sui)著社會(hui)經濟的(de)(de)發(fa)展,社會(hui)公(gong)眾(zhong)(zhong)的(de)(de)環(huan)(huan)(huan)(huan)(huan)境(jing)意識(shi)日益(yi)(yi)增(zeng)強(qiang),但與新《環(huan)(huan)(huan)(huan)(huan)保法》的(de)(de)要求(qiu)還有(you)差距,很多人不(bu)(bu)能(neng)正確履(lv)行(xing)環(huan)(huan)(huan)(huan)(huan)保義務(wu)(wu):一(yi)是(shi)有(you)的(de)(de)缺(que)乏環(huan)(huan)(huan)(huan)(huan)境(jing)意識(shi),不(bu)(bu)懂(dong)法、不(bu)(bu)知法,對(dui)環(huan)(huan)(huan)(huan)(huan)境(jing)保護(hu)漠不(bu)(bu)關心,聽(ting)之任之;二是(shi)有(you)的(de)(de)雖(sui)有(you)環(huan)(huan)(huan)(huan)(huan)境(jing)意識(shi),但不(bu)(bu)能(neng)親(qin)力親(qin)為(wei)踐行(xing)環(huan)(huan)(huan)(huan)(huan)保義務(wu)(wu),一(yi)旦牽涉到個(ge)人利益(yi)(yi)訴求(qiu),便言(yan)行(xing)不(bu)(bu)一(yi),甚(shen)至成為(wei)污(wu)染(ran)制(zhi)造者;三是(shi)有(you)的(de)(de)缺(que)乏環(huan)(huan)(huan)(huan)(huan)保義務(wu)(wu)和責任感,對(dui)政(zheng)府提倡的(de)(de)環(huan)(huan)(huan)(huan)(huan)保行(xing)動不(bu)(bu)能(neng)積極參與;四是(shi)有(you)的(de)(de)監督意識(shi)不(bu)(bu)強(qiang),對(dui)環(huan)(huan)(huan)(huan)(huan)境(jing)違法行(xing)為(wei)不(bu)(bu)制(zhi)止、不(bu)(bu)舉報。

  破除新法實施瓶頸的主要對策

  要(yao)實(shi)行黨(dang)(dang)政(zheng)(zheng)(zheng)(zheng)同(tong)責(ze)(ze),督促(cu)地(di)(di)方(fang)(fang)政(zheng)(zheng)(zheng)(zheng)府(fu)切(qie)(qie)實(shi)落(luo)實(shi)環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)主(zhu)體(ti)責(ze)(ze)任。2015年全國環(huan)(huan)(huan)(huan)境(jing)保(bao)(bao)(bao)護(hu)工作(zuo)(zuo)會議明(ming)確提出(chu)要(yao)著力推動“黨(dang)(dang)政(zheng)(zheng)(zheng)(zheng)同(tong)責(ze)(ze)”、“一(yi)崗(gang)雙責(ze)(ze)”,把(ba)生態文明(ming)建設作(zuo)(zuo)為(wei)地(di)(di)方(fang)(fang)黨(dang)(dang)政(zheng)(zheng)(zheng)(zheng)領(ling)(ling)導(dao)(dao)班子和領(ling)(ling)導(dao)(dao)干(gan)部(bu)政(zheng)(zheng)(zheng)(zheng)績(ji)考(kao)(kao)核(he)(he)評(ping)(ping)價(jia)重要(yao)內容。當前,應凸顯黨(dang)(dang)委的環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)領(ling)(ling)導(dao)(dao)責(ze)(ze)任。地(di)(di)方(fang)(fang)政(zheng)(zheng)(zheng)(zheng)府(fu)對轄區(qu)環(huan)(huan)(huan)(huan)境(jing)質(zhi)(zhi)量負有法定職責(ze)(ze)。黨(dang)(dang)委在資(zi)源配置(zhi)、發展(zhan)導(dao)(dao)向、人事安(an)排(pai)等(deng)方(fang)(fang)面具有決(jue)定性作(zuo)(zuo)用,在嚴峻(jun)的環(huan)(huan)(huan)(huan)境(jing)形勢下,一(yi)旦(dan)黨(dang)(dang)委領(ling)(ling)導(dao)(dao)責(ze)(ze)任虛(xu)化,將不可避免地(di)(di)導(dao)(dao)致政(zheng)(zheng)(zheng)(zheng)府(fu)環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)工作(zuo)(zuo)出(chu)現不確定性。因此(ci),完(wan)善黨(dang)(dang)政(zheng)(zheng)(zheng)(zheng)領(ling)(ling)導(dao)(dao)干(gan)部(bu)考(kao)(kao)核(he)(he)和評(ping)(ping)價(jia)機(ji)(ji)制(zhi),建立健全黨(dang)(dang)委環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)工作(zuo)(zuo)領(ling)(ling)導(dao)(dao)機(ji)(ji)制(zhi)已是當務之急。要(yao)不斷深化督政(zheng)(zheng)(zheng)(zheng)工作(zuo)(zuo),以(yi)環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)綜合(he)督查(cha)為(wei)主(zhu)要(yao)形式(shi),以(yi)地(di)(di)方(fang)(fang)政(zheng)(zheng)(zheng)(zheng)府(fu)為(wei)主(zhu)要(yao)督查(cha)對象,從經濟發展(zhan)與環(huan)(huan)(huan)(huan)境(jing)保(bao)(bao)(bao)護(hu)關系著眼,從地(di)(di)方(fang)(fang)政(zheng)(zheng)(zheng)(zheng)府(fu)、有關職能部(bu)門、排(pai)污單位等(deng)不同(tong)責(ze)(ze)任主(zhu)體(ti)著手,對政(zheng)(zheng)(zheng)(zheng)府(fu)履責(ze)(ze)不到(dao)位的采取(qu)通報、約(yue)談(tan)、限批等(deng)方(fang)(fang)式(shi),推動政(zheng)(zheng)(zheng)(zheng)府(fu)切(qie)(qie)實(shi)承擔起環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)主(zhu)體(ti)責(ze)(ze)任和發揮統(tong)領(ling)(ling)作(zuo)(zuo)用,使地(di)(di)方(fang)(fang)經濟發展(zhan)與環(huan)(huan)(huan)(huan)境(jing)保(bao)(bao)(bao)護(hu)得以(yi)協調推進,環(huan)(huan)(huan)(huan)境(jing)質(zhi)(zhi)量得以(yi)不斷改善。近(jin)期,環(huan)(huan)(huan)(huan)境(jing)保(bao)(bao)(bao)護(hu)部(bu)華北(bei)督查(cha)中心(xin)約(yue)談(tan)了環(huan)(huan)(huan)(huan)境(jing)問題(ti)較多的河南安(an)陽(yang)市(shi)和河北(bei)滄州(zhou)、承德市(shi)政(zheng)(zheng)(zheng)(zheng)府(fu),有力地(di)(di)促(cu)進了問題(ti)整(zheng)改。

  要加強(qiang)人(ren)大(da)(da)(da)、政(zheng)協(xie)監(jian)(jian)督(du)(du)(du),督(du)(du)(du)促政(zheng)府(fu)(fu)強(qiang)化環(huan)(huan)(huan)(huan)保(bao)(bao)履責。人(ren)大(da)(da)(da)監(jian)(jian)督(du)(du)(du)是(shi)(shi)憲(xian)法(fa)賦(fu)予人(ren)大(da)(da)(da)及(ji)其常委會(hui)的(de)(de)(de)(de)重(zhong)要職(zhi)(zhi)權,負有(you)監(jian)(jian)督(du)(du)(du)本級(ji)人(ren)民政(zheng)府(fu)(fu)工作(zuo)之責;民主監(jian)(jian)督(du)(du)(du)是(shi)(shi)憲(xian)法(fa)賦(fu)予政(zheng)協(xie)的(de)(de)(de)(de)重(zhong)要職(zhi)(zhi)能(neng),是(shi)(shi)政(zheng)協(xie)實(shi)施黨(dang)外監(jian)(jian)督(du)(du)(du)的(de)(de)(de)(de)有(you)效形式。尤其是(shi)(shi)面(mian)(mian)對(dui)嚴峻(jun)的(de)(de)(de)(de)環(huan)(huan)(huan)(huan)境形勢和(he)廣大(da)(da)(da)人(ren)民群眾的(de)(de)(de)(de)迫切期待,推(tui)動新(xin)《環(huan)(huan)(huan)(huan)保(bao)(bao)法(fa)》有(you)效實(shi)施,人(ren)大(da)(da)(da)和(he)政(zheng)協(xie)的(de)(de)(de)(de)監(jian)(jian)督(du)(du)(du)必(bi)不可少。一方(fang)(fang)面(mian)(mian),人(ren)大(da)(da)(da)應(ying)(ying)積極監(jian)(jian)督(du)(du)(du)政(zheng)府(fu)(fu)履行環(huan)(huan)(huan)(huan)保(bao)(bao)職(zhi)(zhi)責,通過專題(ti)調研、實(shi)地(di)(di)考察(cha)、明察(cha)暗訪、問卷調查(cha)等多種(zhong)形式,全面(mian)(mian)了(le)解環(huan)(huan)(huan)(huan)保(bao)(bao)真實(shi)狀況,督(du)(du)(du)促政(zheng)府(fu)(fu)嚴格依法(fa)行政(zheng);政(zheng)協(xie)應(ying)(ying)主動開展(zhan)熱點調研,深入開展(zhan)民主監(jian)(jian)督(du)(du)(du),充分(fen)發揮參政(zheng)議(yi)政(zheng)職(zhi)(zhi)能(neng),對(dui)黨(dang)委和(he)政(zheng)府(fu)(fu)落(luo)實(shi)環(huan)(huan)(huan)(huan)保(bao)(bao)主體責任方(fang)(fang)面(mian)(mian)提出及(ji)時(shi)批評和(he)建設性建議(yi),推(tui)動地(di)(di)方(fang)(fang)政(zheng)府(fu)(fu)主動接受監(jian)(jian)督(du)(du)(du)、重(zhong)視監(jian)(jian)督(du)(du)(du)、落(luo)實(shi)監(jian)(jian)督(du)(du)(du)。另(ling)一方(fang)(fang)面(mian)(mian),人(ren)大(da)(da)(da)在加快修訂和(he)完善與新(xin)《環(huan)(huan)(huan)(huan)保(bao)(bao)法(fa)》配套(tao)的(de)(de)(de)(de)各專業法(fa)的(de)(de)(de)(de)同時(shi),應(ying)(ying)充分(fen)重(zhong)視與法(fa)律配套(tao)的(de)(de)(de)(de)行政(zheng)法(fa)規(gui)(gui)(gui)、規(gui)(gui)(gui)章(zhang)制訂不及(ji)時(shi)的(de)(de)(de)(de)問題(ti),將督(du)(du)(du)促國務院(yuan)和(he)相關部門(men)及(ji)時(shi)出臺相關法(fa)規(gui)(gui)(gui)、規(gui)(gui)(gui)章(zhang)作(zuo)為當(dang)前重(zhong)要職(zhi)(zhi)責,確保(bao)(bao)新(xin)《環(huan)(huan)(huan)(huan)保(bao)(bao)法(fa)》有(you)效實(shi)施。

  要不(bu)斷(duan)完(wan)善(shan)環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)體制(zhi)(zhi),保(bao)(bao)(bao)(bao)(bao)(bao)障(zhang)環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)部門(men)(men)統(tong)一實施監(jian)管(guan)(guan)(guan)。為(wei)解決(jue)當前環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)部門(men)(men)監(jian)管(guan)(guan)(guan)的(de)統(tong)籌(chou)性和權威性不(bu)足的(de)苛(ke)疾(ji),需(xu)要對(dui)現行(xing)(xing)環(huan)(huan)(huan)(huan)境管(guan)(guan)(guan)理體制(zhi)(zhi)進行(xing)(xing)改革(ge)。一是建(jian)議在政府層面成立環(huan)(huan)(huan)(huan)境保(bao)(bao)(bao)(bao)(bao)(bao)護(hu)委員會,探(tan)索和完(wan)善(shan)大環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)體制(zhi)(zhi),強(qiang)(qiang)化環(huan)(huan)(huan)(huan)境與(yu)發展的(de)綜(zong)合(he)決(jue)策和協調(diao)機制(zhi)(zhi),使環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)工作由單一的(de)污(wu)染源監(jian)管(guan)(guan)(guan)上(shang)升(sheng)到對(dui)空間(jian)格局、產業結(jie)構(gou)、資(zi)源配(pei)置的(de)調(diao)控和優(you)化。如(ru)山西省長治市成立了環(huan)(huan)(huan)(huan)境保(bao)(bao)(bao)(bao)(bao)(bao)護(hu)委員會,市長為(wei)主(zhu)任,分(fen)管(guan)(guan)(guan)副市長為(wei)副主(zhu)任,辦公(gong)室設在環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)局,政府有(you)關部門(men)(men)設立環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)科,有(you)效地(di)增(zeng)強(qiang)(qiang)了環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)統(tong)一監(jian)管(guan)(guan)(guan)職能(neng)。二是適當歸并環(huan)(huan)(huan)(huan)境監(jian)管(guan)(guan)(guan)職能(neng),減少職能(neng)交叉,有(you)序整合(he)并明(ming)確(que)分(fen)散在不(bu)同領(ling)域、不(bu)同部門(men)(men)、不(bu)同層次(ci)的(de)監(jian)管(guan)(guan)(guan)職能(neng),逐步建(jian)立統(tong)籌(chou)有(you)力(li)(li)、運行(xing)(xing)高效的(de)環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)統(tong)一監(jian)管(guan)(guan)(guan)格局。三是授權環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)部門(men)(men)按照環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)責任目標,定期對(dui)各行(xing)(xing)業、各部門(men)(men)組織開展環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)目標考核,強(qiang)(qiang)化環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)約束機制(zhi)(zhi)。四是強(qiang)(qiang)化環(huan)(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)(bao)部門(men)(men)能(neng)力(li)(li)建(jian)設,明(ming)確(que)將環(huan)(huan)(huan)(huan)境執(zhi)(zhi)法(fa)納入行(xing)(xing)政執(zhi)(zhi)法(fa)序列,統(tong)一服裝,保(bao)(bao)(bao)(bao)(bao)(bao)障(zhang)裝備,增(zeng)加(jia)編(bian)制(zhi)(zhi),盡(jin)快改變現行(xing)(xing)委托執(zhi)(zhi)法(fa)地(di)位(wei),切(qie)實加(jia)大環(huan)(huan)(huan)(huan)境監(jian)管(guan)(guan)(guan)執(zhi)(zhi)法(fa)力(li)(li)度。

  要(yao)(yao)強化有(you)關(guan)部(bu)門(men)環(huan)(huan)(huan)保責(ze)任,促成權(quan)責(ze)相匹配的分工(gong)合(he)作(zuo)格(ge)局。一(yi)切單(dan)位和(he)個人都有(you)保護環(huan)(huan)(huan)境的義(yi)務(wu)。加強環(huan)(huan)(huan)境監(jian)督管(guan)理,各(ge)有(you)關(guan)部(bu)門(men)必須齊抓共(gong)管(guan),形(xing)成合(he)力。一(yi)是(shi)(shi)要(yao)(yao)增強認識,勇于擔當。二是(shi)(shi)明晰職能,責(ze)任到位。三是(shi)(shi)部(bu)門(men)聯動(dong),形(xing)成合(he)力。大力推動(dong)環(huan)(huan)(huan)保與城建、國(guo)土(tu)、水(shui)利(水(shui)務(wu))、公安、農(nong)業、工(gong)信等部(bu)門(men)的聯動(dong)。四是(shi)(shi)嚴格(ge)考(kao)核(he),實行問責(ze)。在考(kao)核(he)政府環(huan)(huan)(huan)保履(lv)責(ze)的同時,應對各(ge)有(you)關(guan)部(bu)門(men)的環(huan)(huan)(huan)保履(lv)責(ze)情況進(jin)行考(kao)核(he),并納入領導干(gan)部(bu)考(kao)核(he)評價體系。

  要落(luo)實企(qi)(qi)(qi)業(ye)治污(wu)(wu)責任,強化守(shou)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)的(de)(de)自(zi)覺性。立法(fa)(fa)(fa)(fa)(fa)(fa)(fa)、執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)、司法(fa)(fa)(fa)(fa)(fa)(fa)(fa),最終還(huan)是(shi)(shi)要落(luo)到守(shou)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)上來。從(cong)目前情況(kuang)看,加(jia)大執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)力度(du)(du)(du)是(shi)(shi)一方面,更重要的(de)(de)是(shi)(shi)企(qi)(qi)(qi)業(ye)要自(zi)律守(shou)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)。對(dui)(dui)此(ci),要多措并舉,綜合施策。一是(shi)(shi)在思想(xiang)上,使(shi)排污(wu)(wu)者(zhe)不愿(yuan)違(wei)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)。要通過各種形式(shi)的(de)(de)宣傳(chuan),強化企(qi)(qi)(qi)業(ye)的(de)(de)守(shou)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)意識。二是(shi)(shi)在制度(du)(du)(du)上,使(shi)排污(wu)(wu)者(zhe)不能違(wei)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)。按照(zhao)新《環保法(fa)(fa)(fa)(fa)(fa)(fa)(fa)》的(de)(de)總體原則和要求,配套相應的(de)(de)制度(du)(du)(du)規定,把制度(du)(du)(du)籠子(zi)扎緊,不讓違(wei)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)者(zhe)有機可(ke)乘。三(san)是(shi)(shi)在執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)上,使(shi)排污(wu)(wu)者(zhe)不敢違(wei)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)。要堅(jian)持(chi)鐵腕執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa),嚴厲處罰,加(jia)強與公安的(de)(de)合作,加(jia)大執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)力度(du)(du)(du)。四是(shi)(shi)在經(jing)濟(ji)(ji)上,運(yun)用(yong)各種經(jing)濟(ji)(ji)手段,利用(yong)經(jing)濟(ji)(ji)杠桿(gan)激勵(li)和約(yue)束企(qi)(qi)(qi)業(ye),對(dui)(dui)企(qi)(qi)(qi)業(ye)利益進(jin)行調節,促使(shi)企(qi)(qi)(qi)業(ye)守(shou)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)自(zi)律。
