  2016年推進簡政(zheng)放(fang)權(quan)放(fang)管(guan)結合優化(hua)服務改(gai)革工作要(yao)點

  2016年是“十三五”規劃開局之(zhi)年,也是推(tui)進(jin)供(gong)給側結(jie)(jie)構性(xing)改(gai)革的(de)攻堅之(zhi)年。今(jin)年推(tui)進(jin)簡(jian)政(zheng)(zheng)放權、放管結(jie)(jie)合(he)、優(you)(you)(you)化(hua)服務改(gai)革的(de)總體要(yao)求是:全面貫徹黨的(de)十八大(da)和(he)十八屆二中、三中、四中、五中全會(hui)(hui)精神,認(ren)真落實中央經濟(ji)工作(zuo)(zuo)會(hui)(hui)議和(he)《政(zheng)(zheng)府工作(zuo)(zuo)報告》部署,按照(zhao)創(chuang)新、協調(diao)、綠(lv)色、開放、共享(xiang)的(de)發展理念,緊(jin)緊(jin)扭住轉變政(zheng)(zheng)府職能這個“牛鼻子”,在(zai)更(geng)大(da)范(fan)圍、更(geng)深層次,以更(geng)有力(li)舉措推(tui)進(jin)簡(jian)政(zheng)(zheng)放權、放管結(jie)(jie)合(he)、優(you)(you)(you)化(hua)服務改(gai)革,使市(shi)場在(zai)資(zi)源配置中起(qi)(qi)決定性(xing)作(zuo)(zuo)用和(he)更(geng)好發揮政(zheng)(zheng)府作(zuo)(zuo)用,破除(chu)制(zhi)約企(qi)業和(he)群眾辦事創(chuang)業的(de)體制(zhi)機制(zhi)障礙,著力(li)降低制(zhi)度性(xing)交易成本,優(you)(you)(you)化(hua)營商環(huan)境(jing),激發市(shi)場活力(li)和(he)社會(hui)(hui)創(chuang)造(zao)力(li),與大(da)眾創(chuang)業、萬眾創(chuang)新和(he)發展壯(zhuang)大(da)新經濟(ji)緊(jin)密(mi)結(jie)(jie)合(he)起(qi)(qi)來,進(jin)一(yi)步形成經濟(ji)增長(chang)內生動力(li),促進(jin)經濟(ji)社會(hui)(hui)持續健康(kang)發展。

   一、持續簡(jian)政放(fang)權,進一步激發市場活力和社會(hui)創造(zao)力

  (一)繼續(xu)深化行(xing)政(zheng)(zheng)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)改革。繼續(xu)加大放(fang)權力度,把該放(fang)的(de)權力放(fang)出(chu)去,能取(qu)(qu)消(xiao)的(de)要(yao)盡量(liang)取(qu)(qu)消(xiao),直接放(fang)給市(shi)場和(he)社會。今年(nian)要(yao)再取(qu)(qu)消(xiao)50項(xiang)(xiang)以上國(guo)務院(yuan)部門行(xing)政(zheng)(zheng)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)和(he)中央指定地方實(shi)施的(de)行(xing)政(zheng)(zheng)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang),再取(qu)(qu)消(xiao)一批(pi)(pi)(pi)(pi)國(guo)務院(yuan)部門行(xing)政(zheng)(zheng)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)中介(jie)服務事(shi)項(xiang)(xiang),削(xue)減(jian)一批(pi)(pi)(pi)(pi)生產許可證(zheng)、經營許可證(zheng)。對確(que)需下放(fang)給基層(ceng)的(de)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang),要(yao)在人(ren)才(cai)、經費、技術、裝備等方面(mian)予以保(bao)障,確(que)保(bao)基層(ceng)接得(de)住、管得(de)好。對相同、相近(jin)或(huo)相關聯的(de)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang),要(yao)一并取(qu)(qu)消(xiao)或(huo)下放(fang),提高放(fang)權的(de)協同性(xing)、聯動(dong)性(xing)。對確(que)需保(bao)留(liu)的(de)行(xing)政(zheng)(zheng)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang),要(yao)統一審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)標準,簡化審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)手續(xu),規范審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)流程。所有(you)行(xing)政(zheng)(zheng)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)都要(yao)嚴格(ge)按法定時限做到“零(ling)超時”。繼續(xu)開展(zhan)相對集中行(xing)政(zheng)(zheng)許可權改革試點,推廣(guang)地方實(shi)施綜(zong)合審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)的(de)經驗(yan)。(國(guo)務院(yuan)審(shen)(shen)(shen)(shen)(shen)改辦牽頭,國(guo)務院(yuan)各有(you)關部門按職(zhi)責(ze)分工負責(ze))

  (二)深入推進(jin)投(tou)(tou)資審(shen)批(pi)(pi)(pi)改革(ge)(ge)。進(jin)一(yi)步擴大(da)企業自主權,再修(xiu)訂政(zheng)府核(he)(he)準的(de)(de)(de)投(tou)(tou)資項(xiang)目(mu)目(mu)錄,中央政(zheng)府層面核(he)(he)準的(de)(de)(de)企業投(tou)(tou)資項(xiang)目(mu)削(xue)減比例累(lei)計達到原總(zong)量的(de)(de)(de)90%以上。出臺(tai)(tai)《企業投(tou)(tou)資項(xiang)目(mu)核(he)(he)準和(he)備案管理條例》。制定中央預算內投(tou)(tou)資審(shen)批(pi)(pi)(pi)制度改革(ge)(ge)方案。出臺(tai)(tai)整合規范投(tou)(tou)資建(jian)設項(xiang)目(mu)報建(jian)審(shen)批(pi)(pi)(pi)事(shi)項(xiang)實施方案。保留的(de)(de)(de)投(tou)(tou)資項(xiang)目(mu)審(shen)批(pi)(pi)(pi)事(shi)項(xiang)要全(quan)部(bu)(bu)納入全(quan)國統(tong)一(yi)的(de)(de)(de)投(tou)(tou)資項(xiang)目(mu)在線(xian)審(shen)批(pi)(pi)(pi)監管平臺(tai)(tai),實行“一(yi)站式”網上審(shen)批(pi)(pi)(pi),大(da)幅縮短(duan)審(shen)批(pi)(pi)(pi)流程和(he)審(shen)批(pi)(pi)(pi)時間,推進(jin)投(tou)(tou)資審(shen)批(pi)(pi)(pi)提(ti)速。(國家發(fa)展改革(ge)(ge)委牽(qian)頭,國土(tu)資源(yuan)部(bu)(bu)、環(huan)境保護部(bu)(bu)、住(zhu)房(fang)城(cheng)鄉建(jian)設部(bu)(bu)、交通運(yun)輸部(bu)(bu)、水利部(bu)(bu)、國務(wu)院(yuan)法制辦等相關部(bu)(bu)門按職責分工負(fu)責)

  (三(san))扎實做好職(zhi)業(ye)(ye)(ye)資(zi)格(ge)(ge)改革。再取消(xiao)一批職(zhi)業(ye)(ye)(ye)資(zi)格(ge)(ge)許可和認定事項,國務院部門(men)設(she)置的(de)職(zhi)業(ye)(ye)(ye)資(zi)格(ge)(ge)削減比(bi)例達(da)到原總(zong)量的(de)70%以上。全(quan)(quan)面清理名目繁(fan)多的(de)各種行業(ye)(ye)(ye)準入(ru)證、上崗證等,不合(he)理的(de)要堅決(jue)取消(xiao)或整合(he)。建(jian)立國家職(zhi)業(ye)(ye)(ye)資(zi)格(ge)(ge)目錄清單管(guan)理制度,清單之外一律不得開展職(zhi)業(ye)(ye)(ye)資(zi)格(ge)(ge)許可和認定工(gong)作,清單之內除準入(ru)類職(zhi)業(ye)(ye)(ye)資(zi)格(ge)(ge)外一律不得與(yu)就(jiu)業(ye)(ye)(ye)創業(ye)(ye)(ye)掛鉤。嚴(yan)肅查處(chu)職(zhi)業(ye)(ye)(ye)資(zi)格(ge)(ge)“掛證”、“助考”等行為,嚴(yan)格(ge)(ge)落實考培分(fen)離。(人力資(zi)源社會保障(zhang)部牽頭,工(gong)業(ye)(ye)(ye)和信息化部、住房城(cheng)鄉建(jian)設(she)部、交通運輸部、國務院國資(zi)委、質(zhi)檢總(zong)局(ju)、安全(quan)(quan)監(jian)管(guan)總(zong)局(ju)、食品藥品監(jian)管(guan)總(zong)局(ju)等相關部門(men)按職(zhi)責分(fen)工(gong)負責)

  (四)持續(xu)推(tui)進(jin)(jin)商(shang)(shang)事制(zhi)(zhi)度改(gai)(gai)(gai)革(ge)。進(jin)(jin)一(yi)(yi)(yi)(yi)(yi)步放寬市(shi)場準(zhun)入,繼續(xu)大力(li)削減工(gong)(gong)商(shang)(shang)登(deng)(deng)記(ji)前置(zhi)審批(pi)事項(xiang),今年(nian)再取消三(san)(san)分之(zhi)一(yi)(yi)(yi)(yi)(yi),削減比例達到原總量的(de)90%以上,同步取消后置(zhi)審批(pi)事項(xiang)50項(xiang)以上。在全面實(shi)(shi)(shi)施企業(ye)“三(san)(san)證(zheng)(zheng)(zheng)合一(yi)(yi)(yi)(yi)(yi)”基礎上,再整合社會保(bao)險(xian)登(deng)(deng)記(ji)證(zheng)(zheng)(zheng)和(he)(he)統計(ji)登(deng)(deng)記(ji)證(zheng)(zheng)(zheng),實(shi)(shi)(shi)現(xian)“五證(zheng)(zheng)(zheng)合一(yi)(yi)(yi)(yi)(yi)、一(yi)(yi)(yi)(yi)(yi)照(zhao)一(yi)(yi)(yi)(yi)(yi)碼”,降低創業(ye)準(zhun)入的(de)制(zhi)(zhi)度成(cheng)本。擴大“三(san)(san)證(zheng)(zheng)(zheng)合一(yi)(yi)(yi)(yi)(yi)”覆蓋面,推(tui)進(jin)(jin)整合個(ge)體工(gong)(gong)商(shang)(shang)戶(hu)營業(ye)執照(zhao)和(he)(he)稅(shui)務(wu)(wu)登(deng)(deng)記(ji)證(zheng)(zheng)(zheng),實(shi)(shi)(shi)現(xian)只(zhi)需填(tian)寫“一(yi)(yi)(yi)(yi)(yi)張表”、向“一(yi)(yi)(yi)(yi)(yi)個(ge)窗口(kou)”提交“一(yi)(yi)(yi)(yi)(yi)套材料(liao)”,即可辦理工(gong)(gong)商(shang)(shang)及(ji)稅(shui)務(wu)(wu)登(deng)(deng)記(ji)。加快推(tui)進(jin)(jin)工(gong)(gong)商(shang)(shang)登(deng)(deng)記(ji)全程電子(zi)化、名稱(cheng)登(deng)(deng)記(ji)、放寬住所條件、簡易注銷登(deng)(deng)記(ji)等改(gai)(gai)(gai)革(ge)試點(dian)(dian)。加快推(tui)行電子(zi)營業(ye)執照(zhao)。抓好“證(zheng)(zheng)(zheng)照(zhao)分離”改(gai)(gai)(gai)革(ge)試點(dian)(dian),切(qie)實(shi)(shi)(shi)減少各種不(bu)必要的(de)證(zheng)(zheng)(zheng),解決企業(ye)“準(zhun)入不(bu)準(zhun)營”的(de)問題,盡快總結形成(cheng)可復制(zhi)(zhi)、可推(tui)廣的(de)經驗。(工(gong)(gong)商(shang)(shang)總局、國務(wu)(wu)院審改(gai)(gai)(gai)辦牽頭,人力(li)資源社會保(bao)障部、稅(shui)務(wu)(wu)總局、國務(wu)(wu)院法制(zhi)(zhi)辦、國家統計(ji)局等相關部門和(he)(he)上海(hai)市(shi)人民政府按職(zhi)責(ze)分工(gong)(gong)負責(ze))

  (五)積(ji)極(ji)開展收費清理改革和監督檢(jian)查。嚴格(ge)落實已出(chu)臺(tai)的各項收(shou)費清理(li)政策,防(fang)止(zhi)反彈或(huo)變相(xiang)收(shou)費。全面清(qing)理和(he)整(zheng)合規范各類認證、評(ping)估、檢(jian)查(cha)、檢(jian)測等(deng)(deng)中介服務,有(you)效解決評(ping)審(shen)評(ping)估事項(xiang)多(duo)、耗(hao)時長、費(fei)用高等(deng)(deng)問題。重點整(zheng)治各種涉(she)企(qi)(qi)亂收費(fei),完善(shan)涉(she)企(qi)(qi)收費(fei)監督檢(jian)查(cha)制度(du),強化(hua)舉報、查(cha)處和(he)問責機制。組織(zhi)對(dui)涉(she)企(qi)(qi)收費(fei)專項(xiang)監督檢(jian)查(cha),切實減輕企(qi)(qi)業負擔。(財政部(bu)、國(guo)家發展改革委(wei)、工(gong)業和信(xin)息化部(bu)牽頭(tou),民政部(bu)、質(zhi)檢總局等相關部(bu)門按職責(ze)分工(gong)負責(ze))

  (六)擴(kuo)大高(gao)(gao)校(xiao)和科(ke)(ke)研(yan)院(yuan)所(suo)自主(zhu)權。凡(fan)是束縛(fu)教(jiao)學(xue)(xue)科(ke)(ke)研(yan)人(ren)員(yuan)積極(ji)性(xing)創(chuang)造性(xing)發揮的不合理(li)規定,都(dou)要取消(xiao)或修改;凡(fan)是高(gao)(gao)校(xiao)和科(ke)(ke)研(yan)院(yuan)所(suo)能夠自主(zhu)管理(li)的事(shi)項,相(xiang)關(guan)權限都(dou)要下放(fang),特別是要擴(kuo)大高(gao)(gao)校(xiao)和科(ke)(ke)研(yan)院(yuan)所(suo)在(zai)經(jing)費使(shi)用(yong)、成(cheng)果(guo)處置(zhi)、職(zhi)稱評審(shen)、選人(ren)用(yong)人(ren)、薪(xin)酬(chou)分(fen)配(pei)、設備采購(gou)、學(xue)(xue)科(ke)(ke)專業(ye)設置(zhi)等方面的自主(zhu)權。落實(shi)完善支(zhi)持教(jiao)學(xue)(xue)科(ke)(ke)研(yan)人(ren)員(yuan)創(chuang)業(ye)創(chuang)新的股權期權激勵等相(xiang)關(guan)政策,促進科(ke)(ke)技(ji)成(cheng)果(guo)轉化。為教(jiao)學(xue)(xue)科(ke)(ke)研(yan)人(ren)員(yuan)從事(shi)兼職(zhi)創(chuang)業(ye)積極(ji)創(chuang)造寬(kuan)松條(tiao)件。(教(jiao)育(yu)部、科(ke)(ke)技(ji)部牽頭,國(guo)務院(yuan)審(shen)改辦(ban)、財政部、人(ren)力(li)資(zi)源(yuan)社(she)會保障部、海關(guan)總(zong)署(shu)、工(gong)商總(zong)局、稅(shui)務總(zong)局、國(guo)家知識產權局、中國(guo)科(ke)(ke)學(xue)(xue)院(yuan)、中國(guo)社(she)科(ke)(ke)院(yuan)、中國(guo)工(gong)程院(yuan)等相(xiang)關(guan)部門、單位按職(zhi)責分(fen)工(gong)負責)

  (七)以政(zheng)(zheng)(zheng)務(wu)(wu)公(gong)(gong)(gong)開(kai)(kai)推動簡政(zheng)(zheng)(zheng)放(fang)權。以更大力(li)(li)(li)度推進(jin)(jin)政(zheng)(zheng)(zheng)務(wu)(wu)公(gong)(gong)(gong)開(kai)(kai),讓人民群眾和(he)企(qi)業了(le)解放(fang)權情(qing)況、監督放(fang)權進(jin)(jin)程(cheng)、評價放(fang)權效(xiao)果,做(zuo)到權力(li)(li)(li)公(gong)(gong)(gong)開(kai)(kai)透明、群眾明白辦事(shi)。全(quan)面公(gong)(gong)(gong)布地方各(ge)級政(zheng)(zheng)(zheng)府部(bu)(bu)門權力(li)(li)(li)清(qing)單(dan)(dan)(dan)(dan)和(he)責任(ren)清(qing)單(dan)(dan)(dan)(dan)。抓緊制(zhi)(zhi)定國務(wu)(wu)院試點部(bu)(bu)門權力(li)(li)(li)清(qing)單(dan)(dan)(dan)(dan)和(he)責任(ren)清(qing)單(dan)(dan)(dan)(dan);在部(bu)(bu)分(fen)地區試點市場準入負(fu)(fu)面清(qing)單(dan)(dan)(dan)(dan)制(zhi)(zhi)度,進(jin)(jin)一步壓縮(suo)負(fu)(fu)面清(qing)單(dan)(dan)(dan)(dan);加(jia)快編制(zhi)(zhi)行政(zheng)(zheng)(zheng)事(shi)業性收(shou)費、政(zheng)(zheng)(zheng)府定價或指導(dao)價經營(ying)服務(wu)(wu)性收(shou)費、政(zheng)(zheng)(zheng)府性基金、國家職(zhi)業資(zi)格、基本(ben)公(gong)(gong)(gong)共服務(wu)(wu)事(shi)項等(deng)各(ge)方面清(qing)單(dan)(dan)(dan)(dan),并及(ji)時主動向(xiang)社(she)會(hui)公(gong)(gong)(gong)開(kai)(kai)。堅持“公(gong)(gong)(gong)開(kai)(kai)為常(chang)態,不(bu)公(gong)(gong)(gong)開(kai)(kai)為例外”,全(quan)面推進(jin)(jin)決策(ce)、執行、管理(li)、服務(wu)(wu)、結果公(gong)(gong)(gong)開(kai)(kai)和(he)重點領域信(xin)息(xi)公(gong)(gong)(gong)開(kai)(kai)。落實(shi)行政(zheng)(zheng)(zheng)許可、行政(zheng)(zheng)(zheng)處(chu)罰等(deng)信(xin)息(xi)自(zi)作出行政(zheng)(zheng)(zheng)決定之(zhi)日起(qi)7個工(gong)作日內上網(wang)公(gong)(gong)(gong)開(kai)(kai)的(de)要求(qiu)。加(jia)大政(zheng)(zheng)(zheng)府信(xin)息(xi)數據開(kai)(kai)放(fang)力(li)(li)(li)度,除涉(she)及(ji)國家安(an)全(quan)、商(shang)業秘密(mi)、個人隱私的(de)外,都應(ying)向(xiang)社(she)會(hui)開(kai)(kai)放(fang)。及(ji)時公(gong)(gong)(gong)開(kai)(kai)突發敏感事(shi)件處(chu)置信(xin)息(xi),回應(ying)社(she)會(hui)關(guan)切。(國務(wu)(wu)院辦公(gong)(gong)(gong)廳牽頭,國務(wu)(wu)院審改辦、國家發展改革委(wei)、教育部(bu)(bu)、公(gong)(gong)(gong)安(an)部(bu)(bu)、民政(zheng)(zheng)(zheng)部(bu)(bu)、財政(zheng)(zheng)(zheng)部(bu)(bu)、人力(li)(li)(li)資(zi)源社(she)會(hui)保障部(bu)(bu)、住房城鄉(xiang)建設部(bu)(bu)、商(shang)務(wu)(wu)部(bu)(bu)、國家衛(wei)生計(ji)生委(wei)、工(gong)商(shang)總局、國家統計(ji)局等(deng)相關(guan)部(bu)(bu)門按職(zhi)責分(fen)工(gong)負(fu)(fu)責)

  二、加(jia)強監管創(chuang)新,促(cu)進社會公平(ping)正義(yi)
