從新《食品安全法》看檢驗檢疫職能轉變

  簡(jian)政(zheng)(zheng)放(fang)權(quan),轉(zhuan)變政(zheng)(zheng)府職(zhi)能,是(shi)黨(dang)中(zhong)央、國務院(yuan)的一項重大舉措。如何在(zai)依法改革(ge)中(zhong)實現簡(jian)政(zheng)(zheng)放(fang)權(quan),在(zai)放(fang)管結合中(zhong)實現職(zhi)能轉(zhuan)變是(shi)一項大課題(ti)。

  新《食(shi)品(pin)(pin)安全(quan)(quan)法(fa)(fa)(fa)》(以(yi)下簡稱“新法(fa)(fa)(fa)”)于(yu)今年(nian)4月(yue)24日(ri)(ri)修訂完(wan)成(cheng),并(bing)于(yu)10月(yue)1日(ri)(ri)起正式實行(xing)。相比舊(jiu)《食(shi)品(pin)(pin)安全(quan)(quan)法(fa)(fa)(fa)》(以(yi)下簡稱“舊(jiu)法(fa)(fa)(fa)”)有巨大(da)改動,一(yi)是明(ming)確(que)了進(jin)口(kou)(kou)食(shi)品(pin)(pin)的(de)法(fa)(fa)(fa)律責任(ren)(ren)。明(ming)確(que)了檢驗檢疫(yi)承擔(dan)監管(guan)職能,企業承擔(dan)主體責任(ren)(ren)(第(di)91、94條(tiao))。此外(wai)還明(ming)確(que)了檢驗檢疫(yi)評估(gu)國外(wai)官方體系的(de)職能(第(di)101條(tiao))。二是進(jin)出口(kou)(kou)檢驗要求的(de)轉(zhuan)變。舊(jiu)法(fa)(fa)(fa)中(zhong)“檢驗合格才能通(tong)關”的(de)法(fa)(fa)(fa)條(tiao)徹底重寫,改為進(jin)口(kou)(kou)食(shi)品(pin)(pin)“依法(fa)(fa)(fa)檢驗合格”,出口(kou)(kou)食(shi)品(pin)(pin)“監督管(guan)理”(第(di)92條(tiao)第(di)2款,第(di)99條(tiao))。三是強(qiang)化了食(shi)品(pin)(pin)安全(quan)(quan)信息(xi)管(guan)理。細化了檢驗檢疫(yi)對食(shi)品(pin)(pin)安全(quan)(quan)信息(xi)收集的(de)范圍(wei)(第(di)100條(tiao)),加強(qiang)了信息(xi)溝(gou)通(tong)的(de)機制(第(di)93條(tiao)第(di)2款,第(di)95條(tiao))。

  本文以(yi)新法對監(jian)督管理(li)職能的(de)(de)明確,及對進(jin)口食品(pin)檢(jian)(jian)驗要求的(de)(de)轉變為切(qie)入點,對檢(jian)(jian)驗檢(jian)(jian)疫機(ji)構如何在(zai)進(jin)口食品(pin)檢(jian)(jian)驗工作中轉變職能,做(zuo)一(yi)個合格的(de)(de)“裁判員”進(jin)行思考(kao)和探討(tao)。

  監督管理,就是做“裁判員”

  新法(fa)(fa)新增(zeng)法(fa)(fa)條(tiao)明確規定,對(dui)進出口食品安全,檢(jian)(jian)(jian)驗(yan)檢(jian)(jian)(jian)疫部門(men)履行“監督管理”職(zhi)(zhi)能(neng)(neng),這為(wei)檢(jian)(jian)(jian)驗(yan)檢(jian)(jian)(jian)疫職(zhi)(zhi)能(neng)(neng)轉(zhuan)變指明了方向。

  監督管(guan)理就是(shi)(shi)做“裁判(pan)員(yuan)(yuan)”。國務(wu)院總理李克(ke)強多次強調,政(zheng)府要(yao)簡政(zheng)放權,做好裁判(pan)員(yuan)(yuan),不(bu)(bu)(bu)要(yao)老想當運動(dong)員(yuan)(yuan)。市場中,企業(ye)是(shi)(shi)“運動(dong)員(yuan)(yuan)”,檢(jian)驗(yan)檢(jian)疫(yi)是(shi)(shi)其(qi)中一個“裁判(pan)員(yuan)(yuan)”,產品質量就是(shi)(shi)“球”。檢(jian)驗(yan)檢(jian)疫(yi)的(de)監管(guan)職(zhi)責(ze),就是(shi)(shi)在球出界(jie)時(shi),吹響哨(shao)聲,并(bing)對運動(dong)員(yuan)(yuan)作出判(pan)罰。但現在的(de)情況是(shi)(shi),這個裁判(pan)員(yuan)(yuan)一邊吹哨(shao),還要(yao)一邊護著(zhu)球不(bu)(bu)(bu)讓它出界(jie)。其(qi)后(hou)果(guo)是(shi)(shi),出了(le)力還不(bu)(bu)(bu)討(tao)好,甚至當球最終出界(jie)時(shi),他還要(yao)承擔“護球不(bu)(bu)(bu)力”的(de)責(ze)罰。

  做“裁判員”就不能做“運動員”

  職能轉(zhuan)變的(de)(de)(de)(de)核心,是檢(jian)(jian)驗模式的(de)(de)(de)(de)改革(ge)。舊法(fa)中“檢(jian)(jian)驗合格才能通(tong)關”的(de)(de)(de)(de)模式,是檢(jian)(jian)驗檢(jian)(jian)疫(yi)成(cheng)為(wei)“運(yun)動(dong)員(yuan)”的(de)(de)(de)(de)原(yuan)因,也是工作風(feng)險(xian)(xian)和(he)廉政風(feng)險(xian)(xian)的(de)(de)(de)(de)主要來源。一是扣留是對(dui)國際貿(mao)易的(de)(de)(de)(de)物流環(huan)節(jie)的(de)(de)(de)(de)行政干預。舊法(fa)要求是扣留檢(jian)(jian)驗,其結果是,檢(jian)(jian)驗成(cheng)為(wei)外貿(mao)活動(dong)中的(de)(de)(de)(de)一環(huan),在(zai)食(shi)品檢(jian)(jian)驗,檢(jian)(jian)驗甚至(zhi)成(cheng)為(wei)貨(huo)物通(tong)關的(de)(de)(de)(de)限(xian)速環(huan)節(jie)。檢(jian)(jian)驗檢(jian)(jian)疫(yi)機構成(cheng)了(le)實際的(de)(de)(de)(de)“運(yun)動(dong)員(yuan)”。企業為(wei)了(le)減少成(cheng)本,傾向(xiang)于尋(xun)找把(ba)關更松的(de)(de)(de)(de)口(kou)岸,或行賄。前者(zhe)凸顯了(le)工作風(feng)險(xian)(xian),后(hou)者(zhe)增加了(le)廉政風(feng)險(xian)(xian)。二是“合格”沒(mei)有(you)定義,責(ze)任(ren)邊界(jie)不明。舊法(fa)中沒(mei)有(you)明確(que)“檢(jian)(jian)驗合格”的(de)(de)(de)(de)依(yi)據,這(zhe)意味著進口(kou)食(shi)品通(tong)關后(hou),發生的(de)(de)(de)(de)任(ren)何問題,檢(jian)(jian)驗檢(jian)(jian)疫(yi)部門都要承擔責(ze)任(ren)。

  新(xin)(xin)法(fa)(fa)為(wei)(wei)檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)模式(shi)改(gai)革(ge)提供上(shang)(shang)位(wei)法(fa)(fa)支撐。一是(shi)(shi)新(xin)(xin)法(fa)(fa)重寫了(le)(le)(le)“合格(ge)(ge)后才能通關”的(de)要(yao)求,為(wei)(wei)檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)模式(shi)的(de)改(gai)革(ge)掃(sao)清了(le)(le)(le)上(shang)(shang)位(wei)法(fa)(fa)的(de)障礙。舊法(fa)(fa)中進口食品“檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)合格(ge)(ge)才能通關”的(de)要(yao)求,是(shi)(shi)檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)檢(jian)(jian)(jian)(jian)疫(yi)機構對進口食品不得(de)不實行檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)模式(shi)的(de)原(yuan)因。為(wei)(wei)了(le)(le)(le)促進外貿,各局創(chuang)新(xin)(xin)舉(ju)措,比(bi)如通過先通關,存入“指(zhi)定(ding)庫”,檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)合格(ge)(ge)后再(zai)放行的(de)方式(shi)。這(zhe)種(zhong)做法(fa)(fa),減少(shao)了(le)(le)(le)貨物滯(zhi)港的(de)成本(ben),但實際(ji)上(shang)(shang)并(bing)不符合上(shang)(shang)位(wei)法(fa)(fa)“檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)合格(ge)(ge)才能通關”的(de)要(yao)求,本(ben)質(zhi)上(shang)(shang)還是(shi)(shi)檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)模式(shi)。二(er)是(shi)(shi)新(xin)(xin)法(fa)(fa)明(ming)確(que)了(le)(le)(le)“檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)合格(ge)(ge)”的(de)依據(ju),劃(hua)清了(le)(le)(le)檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)檢(jian)(jian)(jian)(jian)疫(yi)機構的(de)責(ze)(ze)(ze)任(ren)邊(bian)界(jie)。新(xin)(xin)法(fa)(fa)中明(ming)確(que)了(le)(le)(le)“檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)合格(ge)(ge)”的(de)依據(ju),如果進口食品出(chu)現質(zhi)量問題,只要(yao)檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)檢(jian)(jian)(jian)(jian)疫(yi)依法(fa)(fa)履職,即可免于承(cheng)擔責(ze)(ze)(ze)任(ren)。依據(ju)的(de)明(ming)確(que),使檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)檢(jian)(jian)(jian)(jian)疫(yi)從(cong)原(yuan)先的(de)“無限(xian)責(ze)(ze)(ze)任(ren)”轉成了(le)(le)(le)“有限(xian)責(ze)(ze)(ze)任(ren)”。責(ze)(ze)(ze)任(ren)邊(bian)界(jie)的(de)劃(hua)清,為(wei)(wei)檢(jian)(jian)(jian)(jian)驗(yan)(yan)(yan)(yan)模式(shi)改(gai)革(ge)劃(hua)定(ding)了(le)(le)(le)范圍。

  進口食(shi)品(pin)檢(jian)驗(yan)(yan)(yan)模(mo)(mo)式(shi)改革(ge)的(de)(de)(de)(de)出(chu)(chu)路在3項轉變(bian)。一(yi)是(shi)(shi)(shi)(shi)檢(jian)驗(yan)(yan)(yan),從(cong)對(dui)產品(pin)集的(de)(de)(de)(de)合(he)(he)格(ge)判定,轉向對(dui)生(sheng)產企業(ye)(ye)(ye)管(guan)(guan)(guan)理(li)體(ti)系(xi)(xi)有(you)(you)效(xiao)(xiao)性(xing)(xing)(xing)的(de)(de)(de)(de)驗(yan)(yan)(yan)證(zheng)(zheng)。這樣(yang)才(cai)能實現真(zhen)正意義上的(de)(de)(de)(de)“事(shi)前監(jian)管(guan)(guan)(guan)”。產品(pin)質量(liang)是(shi)(shi)(shi)(shi)企業(ye)(ye)(ye)生(sheng)產出(chu)(chu)來的(de)(de)(de)(de),而不(bu)(bu)是(shi)(shi)(shi)(shi)檢(jian)驗(yan)(yan)(yan)出(chu)(chu)來的(de)(de)(de)(de)。檢(jian)驗(yan)(yan)(yan),是(shi)(shi)(shi)(shi)對(dui)生(sheng)產企業(ye)(ye)(ye)管(guan)(guan)(guan)理(li)體(ti)系(xi)(xi)有(you)(you)效(xiao)(xiao)性(xing)(xing)(xing)的(de)(de)(de)(de)驗(yan)(yan)(yan)證(zheng)(zheng)。這實質上是(shi)(shi)(shi)(shi)將(jiang)監(jian)管(guan)(guan)(guan)延(yan)伸到(dao)國(guo)(guo)(guo)外,延(yan)伸到(dao)生(sheng)產環節。總局對(dui)國(guo)(guo)(guo)外生(sheng)產企業(ye)(ye)(ye)管(guan)(guan)(guan)理(li)體(ti)系(xi)(xi)的(de)(de)(de)(de)評估,不(bu)(bu)再單(dan)單(dan)是(shi)(shi)(shi)(shi)準入門檻(jian),而成了(le)監(jian)管(guan)(guan)(guan)體(ti)系(xi)(xi)的(de)(de)(de)(de)一(yi)個重要組成部分(fen)。此(ci)外,對(dui)特定有(you)(you)毒有(you)(you)害(hai)物(wu)質的(de)(de)(de)(de)檢(jian)驗(yan)(yan)(yan)也是(shi)(shi)(shi)(shi)對(dui)國(guo)(guo)(guo)外官方防控(kong)(kong)體(ti)系(xi)(xi)有(you)(you)效(xiao)(xiao)性(xing)(xing)(xing)的(de)(de)(de)(de)驗(yan)(yan)(yan)證(zheng)(zheng)。二(er)是(shi)(shi)(shi)(shi)合(he)(he)格(ge)判定,從(cong)樣(yang)品(pin)合(he)(he)格(ge),轉向企業(ye)(ye)(ye)合(he)(he)格(ge)。這樣(yang)才(cai)能徹底實現檢(jian)驗(yan)(yan)(yan)模(mo)(mo)式(shi)的(de)(de)(de)(de)改革(ge)。當合(he)(he)格(ge)判定,是(shi)(shi)(shi)(shi)基于來源國(guo)(guo)(guo)家持(chi)續有(you)(you)效(xiao)(xiao)的(de)(de)(de)(de)官方防控(kong)(kong)體(ti)系(xi)(xi),基于生(sheng)產企業(ye)(ye)(ye)持(chi)續有(you)(you)效(xiao)(xiao)的(de)(de)(de)(de)質量(liang)管(guan)(guan)(guan)理(li)體(ti)系(xi)(xi),基于國(guo)(guo)(guo)內外貿易商的(de)(de)(de)(de)高度(du)誠信,直(zhi)通(tong)放行(xing)才(cai)成為可(ke)能。這比傳統(tong)的(de)(de)(de)(de)扣(kou)留檢(jian)驗(yan)(yan)(yan)模(mo)(mo)式(shi),更(geng)(geng)(geng)科學(xue),更(geng)(geng)(geng)可(ke)控(kong)(kong),更(geng)(geng)(geng)可(ke)以持(chi)續改進。三是(shi)(shi)(shi)(shi)監(jian)管(guan)(guan)(guan)的(de)(de)(de)(de)方式(shi),從(cong)“護球”轉為“吹(chui)哨”。這樣(yang)才(cai)算完成真(zhen)正的(de)(de)(de)(de)職能轉變(bian)。檢(jian)驗(yan)(yan)(yan)模(mo)(mo)式(shi)的(de)(de)(de)(de)改革(ge),使得(de)檢(jian)驗(yan)(yan)(yan)檢(jian)疫機構(gou)不(bu)(bu)再干預貿易環節,不(bu)(bu)再承(cheng)擔產品(pin)質量(liang)問題的(de)(de)(de)(de)直(zhi)接責(ze)任,只作為第三方,對(dui)市場(chang)中的(de)(de)(de)(de)企業(ye)(ye)(ye)的(de)(de)(de)(de)違規行(xing)為進行(xing)判罰。防賊變(bian)成捉賊,檢(jian)驗(yan)(yan)(yan)檢(jian)疫的(de)(de)(de)(de)監(jian)管(guan)(guan)(guan)職責(ze)更(geng)(geng)(geng)加明(ming)晰,工(gong)作成效(xiao)(xiao)更(geng)(geng)(geng)易體(ti)現,企業(ye)(ye)(ye)的(de)(de)(de)(de)責(ze)任主體(ti)地位也更(geng)(geng)(geng)加明(ming)確(que)。其他(ta)部門對(dui)市場(chang)監(jian)管(guan)(guan)(guan)的(de)(de)(de)(de)結(jie)果即“事(shi)后監(jian)管(guan)(guan)(guan)”,成為監(jian)管(guan)(guan)(guan)鏈的(de)(de)(de)(de)有(you)(you)機組成部分(fen)。

  做“裁判員”就不能做“教練員”

  政(zheng)府(fu)提供服(fu)務(wu),要依法而為。職權有邊界,因此政(zheng)府(fu)服(fu)務(wu)也有邊界。越界服(fu)務(wu),即(ji)是越權。

  法律條(tiao)文明確了(le)檢(jian)驗(yan)(yan)(yan)檢(jian)疫(yi)(yi)承擔監管職(zhi)責(ze),而企業承擔主體責(ze)任。但是(shi)在實際(ji)操作中(zhong),卻(que)因為(wei)(wei)政府(fu)服務(wu)的(de)邊界不清,政府(fu)部(bu)門很容易越權,成為(wei)(wei)“教(jiao)練(lian)員”。以預包(bao)裝食品(pin)(pin)標簽為(wei)(wei)例,企業為(wei)(wei)了(le)確保其進(jin)口預包(bao)裝食品(pin)(pin)標簽合格,最經濟的(de)途徑是(shi)直接(jie)咨(zi)詢檢(jian)驗(yan)(yan)(yan)檢(jian)疫(yi)(yi)機(ji)構(gou)(gou),獲得肯(ken)定(ding)的(de)答復后再加(jia)貼。檢(jian)驗(yan)(yan)(yan)檢(jian)疫(yi)(yi)機(ji)構(gou)(gou)為(wei)(wei)了(le)促進(jin)外貿,會不厭(yan)其煩地指導企業。最終的(de)結果常是(shi),標簽的(de)有效性(xing)工作,幾乎成了(le)檢(jian)驗(yan)(yan)(yan)檢(jian)疫(yi)(yi)“包(bao)辦”的(de)活。檢(jian)驗(yan)(yan)(yan)檢(jian)疫(yi)(yi)機(ji)構(gou)(gou)既是(shi)“裁(cai)判員”,又是(shi)“教(jiao)練(lian)員”,存在工作和廉政雙重(zhong)風險。

  解(jie)決(jue)的方法(fa)是(shi)須明確(que)政府(fu)(fu)服(fu)務的邊界,將部(bu)分服(fu)務外包給市(shi)場完(wan)(wan)成(cheng)(cheng)。即政府(fu)(fu)牢守“裁判員”底線,將咨(zi)詢(xun)指導的服(fu)務交由“教(jiao)練(lian)員”完(wan)(wan)成(cheng)(cheng)。比(bi)如預包裝食品標(biao)簽的監管中(zhong),政府(fu)(fu)將相關法(fa)律法(fa)規進行(xing)公示(shi),但(dan)在操作層面的咨(zi)詢(xun),外包給市(shi)場完(wan)(wan)成(cheng)(cheng)。市(shi)場上咨(zi)詢(xun)企業(ye)(ye)提供的是(shi)有償(chang)服(fu)務,且自由競爭,這使企業(ye)(ye)有動力提升服(fu)務質量。檢(jian)驗(yan)檢(jian)疫只負(fu)責(ze)規則的發布和解(jie)讀,必要時(shi)對咨(zi)詢(xun)企業(ye)(ye)進行(xing)培訓。(江蘇檢(jian)驗(yan)檢(jian)疫局 張 帆(fan))
